HomeMy WebLinkAbout1980-10-22; Planning Commission; Resolution 1715I r- b c m @ 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 PLANNING COMMISSION RESOLUTION NO. 1715 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE CREATION OF ONE PANHANDLE LOT AS PART OF A MINOR SUBDIVISION LOCATED ON THE SOUTH WEST CORNER OF MONROE STREET, SUNNYHILL DRIVE AND APPLICANT: PACKARD CASE NO: MS-491 ALDER AVENUE IN THE R-1-15,000 ZONE. WHEREAS, a verified application for certain property to, Parcel D and a portion of Parcel B of Parcel Map No, 1337 in the City of Carlsbad, filed in the Office of the County Recorder of San Diego County, February 22, 1973 has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said application constitutes a request as provil by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Carlsbad Municipal Code, Section 21.10.080 provides that any panhandle lots within a minor subdivision m approved by the Planning Commission; and WHEREAS, the Planning Commission did on the 22nd day of October, 1980, hold a hearing as prescribed by law to conside. said request; and WHEREAS, at said hearing, upon hearing and considering a testimony and arguments, if any, of all persons desiring to bl heard, said Commission considered all factors relating to the Minor Subdivision; and 24 Il NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 25 26 27 28 Commission as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the hearing, the Commission recommends APPROVAL of MS-491 based on ths following findings and subject to the following conditio: I 11 . e, - * e 'L 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Findings 1) The property cannot be served adequately with a public s without panhandle lots due to unfavorable conditions res from the lot configuration and existing land development 2) Subdivision with a panhandle lot will not preclude or ad ly affect the ability to provide full public street acce other properties within the same block since the project not set an undesirable precedent or interfere with acces existing or future parcels. 3) The proposed subdivision is consistent with all elements the City's General Plan, including the land use element 1 designates this site for low-medium density residential 1 opment at 0-4 du/acre. 4) The proposed project will not result in any adverse envi mental impacts and it has been found to be exempt from t Carlsbad Environmental Protection Ordinance per Section 19.04.070(C)4, which specifically exempts panhandle lots the R-1 zones in developed areas. 5) The project is consistent with all City public facility : ties and ordinances and with Title 21 of the City's Munil Code. Con'di t'i.ons 1) Approval is granted for MS-491 as shown on Exhibit "A" dm October 10, 1980, incorporated by reference and on file Planning Department. Development shall occur substantia shgwn unless otherwise noted in these conditions. 2) The panhandle lot shall have three non-tandem parking sp' wi.th an approach not less than 24 feet in length with a turnaround area to permit complete turnaround for forwar' a.ccess to the street. Said parking and turnaround shall subject to the approval of the City Engineer. 3) Structures permitted in the access portion of the lot sh limited to mailboxes, fences, trash enclosures, landscap tainers and nameplates. Except for mailboxes, the struc shall not be greater than forty-two inches in height if within twenty feet of the street property line or greate six feet in height beyond this point. 4) The property owner of the panhandle lot shall agree to h the City or any other public service agency harmless fro: liability for any damage to the driveway when being used perform a public service. 5) In addition to these conditions, the applicant shall com with all other conditions placed on the approved parcel j by the City Engineer.
