PLANNING COMMISSION RESOLUTION NO. 1722
A RESOLUTION OF THE PLANNING COYIISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF A ZONE CODE AMENDMENT, AMENDING TITLE 21, CHAPTER 21.42, SECTION 21.42.010(2)
OF THE CARLSBAD MUNICIPAL CODE, BY THE ADDITION
OF SUBSECTION (AA) TO ALLOW WINDMILLS WHICH
EXCEED THE HEIGHT LIMIT UPON APPROVAL OF A
CONDITIONAL USE PERMIT.
APPLICANT: CITY OF CARLSBAD
.CASE NO :. ZCA-128
WHEREAS, the Planning Commission did, on the 12th day of
November, 1980, hold a duly noticed public hearing as prescri
by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and consid
all testimony and arguments, if any, of all persons desiring
be heard, said Commission considered all factors relating to
Zone Code Amendment.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearil the Commission recommends APPROVAL of ZCA-128, according Exhibit "A", dated November 12, 1980, attached hereto an( a part hereof, based on the following findings:

1) Allowing windmills to exceed the height limitation of thc underlying zone provided the purpose of such windmills is to generate usable energy serves the interests of the and facilitates energy conservation.

2) Providing a Conditional Use Permit process to allow windr
to exceed the height limitation will ensure that such
windmills will not create detrimental impacts to surrounc
properties and will be architecturally integrated with ot
buildings on the site.
3) This project will not c ause any significant environment;
impacts, and a declaration of negative environmental imp; has been issued by the Planning Director on October 24, I and approved by the Planning Commission on November 12, 1
