HomeMy WebLinkAbout1980-11-26; Planning Commission; Resolution 1727b a* e a 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 I.8 i 19 ~ 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTIDN NO. 1727 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING SITE DEVELOPMENT PLAN NO. 80-10 TO DEVELOP A COM- MERCIAL OFFICE BUILDING AND DRIVE-THRU BANK ON PROPERTY GENERALLY LOCATED ON THE SOUTHEAST CORNER OF EL CAMINO REAL AND LA COSTA AVENUE IN THE C-1-Q ZONE. APPLICANT: SILVERS CASE NO: SDP .80-10 WHEREAS, a verified application has been filed with the City of Carlsbad, and referred to the Planning Commission; an WHEREAS, said verified application constitutes a request provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Cod the Planning Commission did, on the 26th day of November, 198 consider said request on property described as: That portion lying within Survey No. 1800-1 in Parcel No. 67084-A filed December 3, 1969. WHEREAS, at said hearing, upon hearing and considering a testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to Site Development Plan No. 80-10. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the hearing, the Commission recommends APPROVAL of SDP 80-10, based on tk: following findings and subject to the following conditic Finrdings: 1) The site is physically suitable for the type, density ar design of the development since the property is adequate in size and topography to accommodate the project and st meet all city regulations without any significant envirc mental impacts. . ll e e 1 2 2) The project is consistent with all city public facility 3 policies and ordinances since: a) The applicant has been allocated sufficient sewer hookups for the project. 4 5 6 7 8 b) The applicant has agreed and is required by the inclusion of an appropriate condition to pay a publ. facilities fee. Performance of that contract and payment of the fee will enable this body to find th( public facilities will be available concurrent with need as required by the General Plan. c) All necessary public improvements have either been provided or will be required as conditions of appro. 9 10 11 12 13 14 15 16 3, 17 4, 18 19 I d) The Planning Commission has, by inclusion of an appropriate condition, insured that the project wil not be approved unless the City Council finds that sewer service is available to serve the project. S the project cannot be approved unless sewer service is available, and building cannot occur within the project unless sewer service remains available, the Planning Commission is satisfied that the requireme: of the public facilities element of the General Pla have been met insofar as they apply to sewer servic, for this project. The design of the project and all required improvements not cause any significant environmental impacts, and a Declaration of Negative Environmental Impact has been issued by the Planning Director on October 2, 1980, Log No. 760. The proposed development is consistent with the Land Use Element and all other applicable elements of the General Plan. 2o /1 5) The proposed development as conditioned is consistent wi surrounding development, both existing and future. 21 22 23 24 General Conditions: 1. Approval is granted for SDP 80-10, as shown on Exhibits A, B, & C, dated July 25, 1980, incorporated by reference and on file in the Planning Department. This project is approved upon the express condition that building permits will not be issued for development of t subject property unless the City Engineer determines tha 27 sewer facilities are available at the time of applicatio such sewer permits and will continue to be available unt 28 time of occupancy. PC RES0 # 1727 Page 2 I ,. 5 - - -il e a 1 3- 2 3 4 5 This project is approved upon the express condition that applicant shall pay a public facilities fee as required 1 City Council Policy No. 17, dated August 29, 1979, on fil with the City Clerk and incorporated herein by reference, according to the agreement executed by the applicant for payment of said fee a copy of that agreement dated July 21, 1980, is on file with the City Clerk and incorporatec herein by reference. If said fee is not paid as prornisec this application will not be consistent with the General Plan and approval for this project shall be void. 6 4. The applicant shall prepare a revised site plan incorpor; the conditions contained herein.
