PLANNING COMMISSION RESOLUTION NO. 1729
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF A ZONE CODE AMENDMENT, AMENDING TITLE 21, CHAPTER 21.49, OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTION 21.49.020 TO ALLOW THE ACCEPTANCE OF APPLICATIONS AND THE PROCESSING OF TENTATIVE MAPS. APPLICANT: CITY OF CARLSBAD CASE NO: ZCA-130
WHEREAS, the Planning Commission did, on the 26th day c
November, 1980, hold a duly noticed public hearing as prescr
by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and consj
all testimony and arguments, if any, of all persons desiring
heard, said Commission considered all factors relating to tl
Zone Code Amendment.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
A) That the above recitations are true and correct.
B) That based on the evidence presented at the public heal
the Commission recommends APPROVAL of ZCA-130, accordir Exhibit "A", dated December 17, 1980, attached hereto t
a part hereof, based on the following findings:
Findings :
1) The amendment will allow applications for projects in t to be served by satellite sewage treatment plants to be accepted and processed as long as the applicant is will waive the applicable time limits.
2) The amendment will still require that the City Council
the satellite sewage treatment plant before the Council actually approves the project.
3) That the Phase I11 expansion of Encina and the Calaver: Plant are not completed, but that it is reasonable to z that they will be completed in the future. Therefore, while the Planning Commission finds there is a reasonal expectation that sewer will be available and that the moratorium should be lifted to allow processing and in! approval of projects, final approval including buildinl

permits and final maps shall not be issued unless the City Council finds sewer is in fact available.

does ordain as follovs:
SECTION I: That Title 21, Chapter 21.49 I Section
21.49.020 of the Carlsbad Municipal Code is amended by the
amendme.nt of Subsection .(11) which reads as follows:

EFFECTIVE DATE: This ordinance shall be effective
days after its adoption, and the City Clerk shall certify to
adoption of this ordinance and cause it to be pu-blished at le<
once in the Carlsbad Journal within fifteen days after its
adoptiono
