A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A CONDI-
TIONAL USE PERMIT TO DEVELOP A DRIVE-THRU BANK BUILDING AND TEMPORARY BANKING FACILITIES ON
PROPERTY GENERALLY LOCATED ON THE SOUTHEAST
CORNER OF PALOMAR AIRPORT ROAD AND YARROW DRIVE. APPLICANT: McROSKEY
CASE NO: CUP-185

WHEREAS, a verified application has been filed with the
City of Carlsbad and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request
as provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code
the Planning Commission did, on the 14th day of January,
1981, hold a duly noticed to consider said application on
property described as:
Lot 1 of Tract 73-49 of Map No. 8054 filed December
31, 1974.

2) That the site is adequate in size and shape to accomodatt
the use for the reasons stated in the staff report.
3) That, as conditioned, the street system serving the use
adequate to properly handle all traffic generated becaus
the project is served by a major and secondary arterial street which will be improved to city standards prior to occupancy of any buildings.
4) The project will not cause any significant environmental
impacts and a negative declaration has been issued by thc
Planning Director on November 21, 1980, and approved by
the Planning Commission on January 14, 1981.
5) The project is consistent with all city public facility policies and ordinances since:
a. The Planning Commission has, by inclusion of an
appropriate condition to this project insured that
the project will not be approved unless the City
Council finds that sewer service is available to
serve the project. Since the project cannot be
approved unless sewer service is available, and building cannot occur within the project unless sewer service remains available, the Planning Commission is satisfied that the requirements of the public facilities element of the general plan have been met insofar as they apply to sewer
service for this project.

or will be required as conditions of approval.
c. The applicant has agreed and is required by the
inclusion of an appropriate condition to pay
a public facilities fee. Performance of that con- tract and payment of the fee will enable this body

1) Approval is granted for CUP-185, as shown on Exhibit A,
dated January 9, 1981 and Exhibits "B" and "C", dated
December 15, 1980, incorporated by reference and on file
in the Planning Department. Development shall occur
substantially as shown unless otherwise noted in these
conditions.
2) This project is approved upon the express condition that
building permits will not be issued for development of the
subject property unless the City Engineer determines that
sewer facilities are available at the time of application
such sewer permits and will continue to be available until
time of occupancy.
