A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A VARIANCE TO REDUCE THE SIDEYARD SETBACK FROM FIVE FEET TO
ONE FOOT GENERALLY LOCATED ON THE EAST SIDE OF
ROOSEVELT STREET.
APPLICANT: IONA ELSNER

6 II WHEREAS, a verified application for certain property, to

a Lot 8 of Block 42 of Carlsbad Map No. 535 filed May 2, 1888.

has been filed with the City of Carlsbad, and referred to the
Planning Commission: and

WHEREAS, said verified application constitutes a request
provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 14th day of

January, 1981, hold a duly noticed public hearing as prescribc
law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considl
all testimony and arguments, if any, of all persons desiring
heard, said Commission considered all factors relating to V-3
19 I NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning

Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
22 B) That based on the evidence presented at the public heari

the Commission APPROVES V-315, based on the following fi
25 I 1) There are exceptional circumstances applicable to the
26
property that do not apply to other properties in the vicinity because the lot is extremely narrow in width,
27
and as such, a patio cover in another location is not possible.

2) That the granting of this Variance will ensure that thi:
property will not be denied a substantial property shart by other properties in the same vicinity and zone becau:
the patios will allow a degree of privacy shared by
these other properties. Further, other properties
in the same vicinity and zone have similar setback
reductions which would be denied to this property if
the Variance was not granted.
3) The granting of the requested Variance will not have
a detrimental effect on other property in the same
vicinity and zone.
4) That granting of this Variance will not adversly affect
the City's General Plan.
