'1750 2 3 4 5 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO PERMIT A CIRCUS EVENT IN A PARKING LOT ON PROPERTY GENERALLY LOCATED ON THE WESTERLY EDGE OF THE PLAZA CAMINO REAL ADJACENT TO MARRON ROAD. APPLICANT: CIRCUS VARGAS CASE NO: CUP-193 ' 11 WHEREAS, a verified application has been filed with the 7 //City of Carlsbad and referred to the Planning Commission; and 8 9 IO WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Cod 111/ the Planning Commission did, on the 14th day of January, 1981 l2 11 hold a duly noticed public hearing to consider said applicati l3 11 on property described as: 14 15 16 WHEREAS, at said public hearing, upon hearing and 17 considering all testimony and arguments, if any, of all perso 18 desiring to be heard, said Commission considered all factors 19 i relating to CUP-193. 20 21 Commission of the City of Carlsbad as follows: 22 A) That the foregoing recitations are true and correct. 23 B) That based on the evidence presented at the public heari 24 the following findings and subject to the following A portion of Lot 27 of Carlsbad Tract 76-18 according to Map No. 8956. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning the Commission recommends APP'ROVAL of CUP-193, based on conditions: 25 11 Findings 26 27 1. The proposed Conditional Use Permit will not result in an significant environmental impacts since the circus is categorically exempt from the Carlsbad Environmental Protection Ordinance as per Section 19.04.070(f)(3). 3. The subject property can adequately accommodate the circu since sufficient area is available for the circus, parkin and all necessary appurtenances, and since the site is relatively level and already paved requiring no significa site modifications or alteration. ~ 4. All of the features necessary to adjust the requested use to existing uses in the area will be provided and maintai I 8 9 5. Adequate public facilities necessary to serve the propose circus will be available since: a. The subject site is served by an adequate public 10 12 b. The site is accessible from the freeway and from 11 street system; c. The applicant will be providing adequate sanitary, 13 electric and water service to the property for the 14 15 several other access points; duration of the circus. Approval is granted for CUP-193, as shown on Exhibit "A" to CUP-193, dated December 17, 1980 on file in the Planni Department and incorporated by reference. Development sh occur substantially as shown on this exhibit unless other noted in these conditions. The days and hours of circus performances shall be as fol January 27th, 1981 (8 P.M. to 10 P.M.), January 28th and 29th, 1981 (noon to 10 P.M.). The subject property shall be cleared of all equipment and temporary improvements and returned to its pre-existi state no later than noon on January 30, 1981. The applicant shall obtain the approval and comply with all requirements and recommendations of the Police, Fire and any other affected City Departments.
