'1703 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL FOR A 6 LOT TENATIVE TRACT MAP ON PROPERTY GENERALLY LOCATED ON AVENIDA ENCINAS BETWEEN PALOMAR AIRPORT ROAD AND CANNON ROAD. APPLICANT: BUDGE CASE NO: CT 80-15 (A) WHEREAS, a verified application for certain property to wit: Parcel 2 of Parcel Map 10801 recorded December 17, 1980 has been filed with the city of Carlsbad, and referred to thl Planning Commission; and WHEREAS, said verified application constitutes a reques as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 28th day o January, 1981, hold a duly noticed public hearing as prescri: by law to consider said request; and WHEREAS, at said public hearing, upon hearing and consi all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating i I the Tentative Tract Map. NOW, THEREFORE, BE IT HEREBY RESOVED by the Planning Commission as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the pubic heari the Commission recommends. APPROVAL of CT 80-15(A), base on the following findings and subject to the following conditions : Findings: 1. The site is physically suitable for the type of develop] proposed since the basically flat topography of the sit1 reduces the need for major land form alteration. 3. The project is consistent with all city public facility policies and ordinances since: a) The Planning Commission has, by inclusion of an appropriate condition to this project, insured tha the final map will not be approved unless the City Council finds that sewer service is available to serve the project. In addition, the Planning Com- mission has added a condition that a note shall be placed on the final map that building permits may not be issued for the project unless the City Engi determines that sewer service is available. Since the final map cannot be approved unless sewer serv is available, and building cannot occur within the project unless sewer service remains available, th Planning Commission is satisfied that the requirem of the public facilities element of the General Plan have been met insofar as they apply to sewer service for this project. b) All necessary public improvements have been provid or will be required as conditions of approval. c) The applicant has agreed and is required by the inclusion of an appropriate condition to pay a pub facilities fee. Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurren with need as required by the General Plan. 4. The Planning Director has determined that the proposed project has been addressed in previously approved envir mental documents and issued a Notice of Prior Environme Compliance on January 7, 1981. Conditions 1. All previous conditions of CT 80-15 (Resolution 1638) are no longer applicable and shall be superseded by the conditions of approval contained herein. 2. Approval is granted for CT 80-15(A), as shown on Exhibi E, H, 1 and M and Exhibit S, dated August 26, 1980 and December 4, 1980, incorporated by reference and on file in the Planning Department. This project is approved upon the express condition thai the final map shall not be approved unless the City COUI finds as of the time of such approval that sewer servicc is available to serve the subdivision. 4. This project is approved upon the express condition tha. building permits will not be issued for development of ' subject property unless the City Engineer determines thi sewer facilities are available at the time of applicatic for such sewer permits and will continue to be availablc until time of occupancy. 5. This project is approved upon the express condition tha, applicant shall pay a public facilities fee as required City Council Policy No, 17, dated August 29, 1979, on f with the City Clerk and incorporated herein by referencl according to the agreement executed by the applicant fo. payment of said fee a copy of that agreement dated Febr, 28, 1980, is on file with the City Clerk and incorporat, herein by reference. If said fee is not paid as promisl this application will not be consistent with the Genera Plan and approval for this project shall be void. 6. Approval of this request shall not excuse complicance w all sections of the Zoning Ordinance and all other appl city ordinances in effect at time of building permit is Planning Department 7. The applicant shall establish a property owner's associ and corresponding covenants, conditions and restriction Said CC&R's shall be submitted to and approved by the P Department prior to final map approval. 8. The applicant shall prepare a detailed landscape and irrigation plan which shall be submitted to and approve by the Planning Director prior to issuance of a buildin permit. 9. Parking lot trees shall be a minimum 15 gallon size. 10. All landscaped areas shall be maintained in a healthy a thriving condition, free from weeds, trash, and debris. 11. Any signs proposed for this development shall be design in conformance with the city's Sign Ordinance and shall require review and approval of the Planning Department prior to installation of such signs. 12. A uniform sign program for this development shall be su mitted to the Planning Department for their review and approval prior to occupancy of any building. Trash receptable areas shall be enclosed by a 6 foot hi5 masonry wall with gates pursuant to city standards. LOC of said receptacles shall Be approved by the Planning Director. 14. All roof appurtenances, including air conditioners, sha! be architecturally integrated and shielded from view anc the sound buffered from adjacent properties and streets to the satisfaction of the Planning Department and Builc Director. 15. The project shall provide bus stop facilities at locatic subject to the satisfaction of the North County Transit District. Said facilities shall at a minimum include a bench, free from advertising and a pole for the bus st01 sign. The bench and pole shall be designed in a manner as to not detract from the basic architectural theme of project and said design shall be subject to the approva: the Planning Director and North County Transit District 16. The project shall attempt to develop a ride to work and home program for its employees with the North County Tri District. Furthermore, the project shall attempt to li! the staggering of worker shifts so as to facilitate the success of said program. 17. All conditions of Resolution No. 1704, for PUD-l7(A) Shi be met. Engineering Department 18. The subdivider shall dedicate and improve Avenida Encin based on a right-of-way width of 70’ and a curb-to-curb width of 60’. The limits shall be from the existing te: of Avenida Encinas, along the subdivision frontage, exti off-site to Cannon Road. The right-of-way shall be ded prior to the approval of the final map and shall be frei clear of any liens and encumbrances. The improvements be for the full street width including median and shall conform to the city of Carlsbad standards subject to thl approval of the City Engineer and shall be completed pr final occupancy of any units. 19. Improvement plans prepared by a registered civil engine must be approved by the City Engineer, required securit posed, and improvement agreement executed prior to appr of the final map. 20. Interior private streets and driveways shall be built t width to serve all buildings being constructed. 21. All required fees and deposits shall be paid prior to fir map. 23. Separate final maps may be recorded for Phase 1 and Phase 2 of the development as long as all applicable conditions of approval contained herein are complied wit1 Fire Department 24. Additional public and on-site fire hydrants shall be installed if required by the Fire Marshall. 7 25. The applicant shall submit two (2) copies of a site plan showing locations of existing and proposed fire hydrants a on-site roads and drives. 9 26. An all weather access road shall be maintained throughou. construction. 10 27. Water for fire protection shall be installed prior to 11 placement if any on the building site. 12 13 14 15 16 17 18 19 I 20 .21 28. Recommended minimum standards by the Fire Department for driveways into all types of building construction shall be no parking land - 24 feet, parking one side 34 feet, and parking both sides 44 feet. 29. Adequate emergency vehicle turn-arounds shall be provide( by a cul-de-sac or a hammerhead when a driveway is more than 150 feet deep from property line at street. 30. All private driveways shall be kept clear of parked vehi at all times, and shall have posted “no parking/fire Ian tow away zone” as per condition in Municipal Code. 31. All fire alarm systems, fire hydrants, extinguishing sys automatic sprinklers, and other systems pertinent to the project shall be installed pursuant to Fire Code and Bu?lding Code requirements and shall be submitted to the Fire Department for approval prior to construction.
