II PLANNING COMMISSION SOLUTION NO. 1736 2 3 4 5 6 7 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING VARIANCES TO REDUCE THE REQUIRED FRONT YARD, TO ALLOW PARKING IN THE REQUIRED FRONT AND A CONDOMINIUM BUILDING GENERALLY LOCATED ON THE WEST SIDE OF OCEAN STREET BETWEEN BEECH STREET AND CYPRESS AVENUE. APPLICANT: DOMINY CASE NO: V-312 SIDE YARD, AND TO PERMIT TANDEM PARKING FOR a // WHEREAS, a verified application for certain property, to 9!lwit: IO 11 12 Lot 1 in Block "A" of Hayes Land Co. addition to Carlsbad Map No. 2, according to map thereof No. 1221, filed November 4, 1909 and a portion of Lot 1, in Block 2 of Oceanside addition to Carlsbad accorditrig to map thereof No. 893, filed in the office of the County Recorder. 13 14 15 16 17 18 has been filed with the City of Carlsbad, and referred to the Planning Commission: and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code: and WHEREAS, the Planning Commission did, on the 10th day of December, 1980, hold a duly noticed public hearing and on the day of January, 1981, a continued public hearing as prescribed law to consider said request; and 19 I 20 21 22 23 WHEREAS, at said public hearing, upon hearing and conside: all testimony and arguments, if any, of all persons desiring tl he heard, said Commission considered all factors relating to 24 IlV-312. 25 26 27 28 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) .That based on the evidence presented at the public hearin< the Commission APPROVES V-312, based on the following finc APN: 203-140-28 .- *. * * 1 Findings: 2 1) That there are exceptional or extraordinary circumstance or conditions applicable to this property that do not aE generally to the other property in the same vicinity and on the west side of Ocean Street. 3 because of the lots irregular configuration which are tl 4 5 6 7 a 9 10 11 12 13 14 2) That the subject property is being denied a substantial property right possessed by other property in the same vicinity and zone because other properties have tandem parking and reduced setbacks. 3) That the granting of such variances would not be materia detrimental to the public welfare and injurious to the property in the vicinity and zone in which the property located. 4) That the granting of such variances would not adversely affect the City's General Plan. Conditions 1) Approval is granted for 71-312, a5 shown on Exhibit A, da. May 12, 1980, incorporated by reference and on file in tl Planning Department.
