I PLANNING COMMISSION RESOLUTION NO. 1760
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A CONDI-
TIONAL USE PERMIT TO ALLOW AN ANNUAL FAIRE ON
PROPERTY GENERALLY LOCATED ON THE EASTERLY
PORTION OF CARLSBAD RACEWAY NORTH OF PALOMAR
AIRPORT ROAD AND WEST OF LINDA VISTA ROAD.
APPLICANT: SUN FAIRE
CASE NO: CUP-191
WHEREAS, a verified application has been filed with the
' City of Carlsbad and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request
as provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Cod
the Planning Commission did, on the 28th day of January, 1981
hold a duly noticed to consider said application on property
described as:

Southwest Quarter of Northeast Quarter of Section 18,
Township 12 South, Range 3 West, San Bernardino Base
and Meridan.
WHEREAS, at said public hearing, upon hearing and
considering all testimony and arguments, if any, of all persc
desiring to be heard, said Commission considered all factors
relating to CUP-191.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public heari
the Commission APPROVES CUP-191, based on the following findings and subject to the following conditions:
Findings:
1. The street system serving the use is adequate to proper1
handle all traffic generated by the use.
2. The subject property is adequate in size and shape to
accomodate the use.

1 3. All of the features necessary to adjust the use and
make it compatible with other existing and permitted
2 uses in the neighborhood will be provided and maintained

4. The use is desirable for the community and conforms with the various elements of the General Plan.
5. The project will not cause any significant environmental
impacts and a Negative Declaration has been issued by
the Planning Director on January 5, 1981 and approved by the Planning Commission on January 28, 1981.

This project is approved upon the express condition that
the applicant shall pay a public facilities fee as requi
by City Council Policy No. 17, dated August 29, 1979, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by th applicant for payment of said fee a copy of that agreeme dated December 2, 1980, is on file with the City Clerk and incorporated herein by reference. If said fee is no paid as promised, this application will not be consisten with the General Plan and approval for this project shal
be void.
17 3. Prior to the opening of the faire, the applicant shall submit a parking layout plan which shall show where 18 driveways and parking spaces will be located on the
parking area. This plan shall be approved by the Planni
Director and shall be complied with by the operators of
the faire.

All parking areas shall be sprinkled with water on a
weekly basis or more frequently if needed to control dus
to the satisfaction of the Planning Director.
Private traffic control shall be provided at the entranc
the faire and shall be coordinated and approved in advan
with the Carlsbad Police Department and the Engineering
Department. Traffic control shall also be provided at t
El Camino Real/Palomar Airport intersection unless the n
traffic signal is operative at this intersection prior t

7. If approved by the City Engineer, the eastbound left

11. The faire shall be permitted to operate from 1O:OO A.M. to 7:OO P.M, on Thursday, Friday, Saturday and Sundays from May 1 to September 30 only. Any change in the hour days or months of operation shall require an amendment to this conditional use permit.
12. The faire shall be closed on the Sunday when the Interna Motocross event is held at the raceway.
13. The applicant shall obtain an appropriate business licen
from the City Council.
14. The applicant shall contact the Building Official prior
to the installation or construction of any structures on the site to determine the necessity for building permits and to obtain said permits if required.
15. The applicant shall comply with all applicable state and
local fire regulations pertaining to treatment of decora
material, brush clearance, portable fire extinguishers,
of propane, and electrical requirements.
16. Required approvals from all other agencies including the
Public Health Department and Alcoholic Beverage Control (if alcoholic beverages are to be sold on the premises) shall be obtained.
17. Sanitary facilities (portable toilets) shall be provided
in a number to be determined by the Public Health Depart

18. The applicant shall provide proof to the satisfaction of the Planning Director that the applicant has use of the strip of property to the south of the faire site.

19. Amplified music shall be permitted only in the open-air theater area.
20. This conditional use permit shall expire in six years
unless extended by the Planning Commission.
21. This conditional use permit shall be scheduled for revie\
by Planning Commission on an annual basis at which time .

and a determination shall be made as to whether any unanticipated problems have arizen. If additional conce:

22. The faire shall be operated at all times in a manner not detrimental to surrounding properties and uses.
23. The applicant shall pick up trash along Palomar Airport
between the subject property and El Camino Real on a wee: basis subject to the approval of the Planning Director.
24. After the first week of opening and every four weeks the after a traffic review shall be conducted by the Planninl Police Departments. If traffic problems are occuring, tâ
