HomeMy WebLinkAbout1981-02-11; Planning Commission; Resolution 1762\ I- ' a e 1 II PLANNING COMMISSION RESOLUTION NO. 1762 2 3 4 5 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE CREATION OF ONE PANHANDLE LOT AS PART OF A MINOR SUBDIVISION LOCATED ON THE WEST SIDE OF SUNNYHILL DRIVE IN THE R-1-15,000 ZONE. APPLICANT: SCHLEHUBER CASE NO: MS-509 6 WHEREAS, a verified application for certain property to, 7 a A portion of Lot I of Rancho Agua Hedionda, according to Map No. 823 filed November 16, 1896. WHEREAS, said application constitutes a request as provic 9 10 11 12 13 14 15 16 17 by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Carlsbad Municipal Code, Section 21.10.080 provides that any panhandle lots within a minor subdivision ml be approved by the Planning Commission; and WHEREAS, the Planning Commission did on the 11th day of February, 1981, hold a hearing as prescribed by law to considc said request; and WHEREAS, at said hearing, upon hearing and considering a. testimony and arguments, if any, of all persons desiring to bc 181i heard, said Commission considered all factors relating to the 19 /I 1 Minor Subdivision; and 2o II NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 21 I/ Commission as follows: 22/i A) That the foregoing recitations are true and correct. 23 24 the Commission recommends approval of MS-509 based on B) That based on the evidence presented at the hearing, the following findings and subject to the following 25 Findings 26 ' conditions: 27 1) The property cannot be served adequately with a public s without a panhandle lot due to unfavorable conditions re 28 from the lot configuration and existing land development APN NO. 207-310-07 c i a e 1 2) Subdivision with a panhandle lot will not preclude or ad7 ly affect the ability to provide full public street acce: 2 other properties within the same block. 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 1 21 22 23 24 25 26 27 28 3) The proposed subdivision is consistent with all elements the City's General Plan, including the land use element T designates this site for low-medium density residential ( opment at 0-4 du/acre. 4) The proposed project will not result in any adverse envil mental impacts and it has been found to be exempt from tl Carlsbad Environmental Protection Ordinance per Section 19.04.070 (f) (4c and 4d), which specifically exempts pal handle lots in the R-1 zones in developed areas. 5) The project is consistent with all city public facility 1 cies and ordinances, and with Title 21 of the city's Municipal Code. Conditions 1) Approval is granted for MS-509 as shown on Exhibit "A" dated January 21, 1981, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. 2) The panhandle lot shall have three non-tandem parking Spi with an approach not less than 24 feet in length with a 1 turnaround area to permit complete turnaround for forwarc access to the street. Said parking and turnaround shall subject to the approval of the City Engineer. 3) Structures permitted in the access portion of the lot sh( limited to mailboxes, fences, trash enclosures, landscapc tainers and nameplates. Except for mailboxes, the struc shall not be greater than forty-two inches in height if located within twenty feet of the street property line 0: greater than six feet in height beyond this point. 4) The property owner of the panhandle lot shall agree to hc the city or any other public service agency harmless fro] liability for any damage to the driveway when being used perform a public service. 5) In addition to these conditions, the applicant shall com] with all other conditions placed on the approved parcel 1 by the City Engineer. 6) The buildable potion of the panhandle lot shall be all portions of the lot that have a width of greater then 35 feet.
