HomeMy WebLinkAbout1981-02-11; Planning Commission; Resolution 1764i b I 11 e a 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION 'RESOLUTION NO. 1764 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW AN INCREASE IN RETAIL AREA WITH A CORRESPONDING DECREASE IN STORAGE AREA AND TO ALLOW AN OUTSIDE EATING AREA FOR THE TIP TOP MEAT MARKET AND DELI ON PROPERTY GENERALLY LOCATED ON THE EAST SIDE OF PASEO DEL NORTE, SOUTH OF PALOMAR AIRPORT ROAD. APPLICANT: HAWTHORNE CASE NO: - CUP-l62(A) WHEREAS, a verified application has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Codt the Planning Commission did, on the 11th day of February, 198: hold a duly noticed public hearing to consider said applicatic property described as: Parcels A and B of Map 4279 filed in San Diego County. WHEREAS, at said public hearing, upon hearing and considc all testimony and arguments, if any, of all persons desiring . be heard, said Commission considered all factors relating to CUP-162 (A) . NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearil the Commission recommends APPROVAL of CUP-l62(A), based ( the following findings and subject to the following conditions: Findinas: d 1) That the requested expansion of the uses is desirable fol the development of the community, is essentially in harm( APN: 211-040-19 li 4 /I 0 a 1 2 3 4 5 with various elements and objectives of the General Plan, and is not detrimental to existing uses or to uses specifically permitted in the zone as discussed in the staff report. 2) That the site for the intended expansion is adequate in s and shape to accommodate the use as adequate off street parking will be provided and there will be no physical expansion. 6 3) That all of the yards, setbacks, walls, fences, landscapi and other features necessary will be provided and maintai: 7 as discussed in the staff report. 8 4) That the street system serving the proposed expansion of uses is adequate to properly handle all traffic generated 9 by the proposed expansion. 10 5) That the project is in substantial conformance with SP-23 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 I 6) That the Planning Director has found this project to meet all requirements of the Carlsbad Environmental Protection Ordinance by prior compliance pursuant to a negative declaration issued on April 11, 1979. 7) The applicant has agreed and is required by the inclusion of an appropriate condition to pay a public facilities fe Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurrent with need as required by the General Conditions: 1) Approval is granted for CUP-l62(A), as shown on Exhibit A B, and C, dated February 4, 1981, incorporated by referenc on file in the Planning Department. Development shall occ substantially as shown unless otherwise noted in these conditions. 2) This project is approved upon the express condition that . applicant shall pay a public facilities fee as required b City Council Policy No. 17, dated August 29, 1979, on filc with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant f payment of said fee a copy of that agreement dated Decembc 3, 1980, is on file with the City Clerk and incorporated herein by reference.
