PLANNING COMMISSION RESOLUTION NO. 1769
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, DENYING A VARIANCE TO REDUCE THE SIDEYARD SETBACK FROM 7.7' TO 4.2' GENERALLY LOCATED ON THE END OF JEREZ COURT IN
THE RD-M ZONE. APPLICANT: LENACK
CASE NO: V-319
WHEREAS, a verified application for certain property, to
wit:
1/5 interest of Lot 1 of Map 7872 filed February 21, 197
has been filed with the City of Carlsbad, and referred to the
Planning Commission; and
WHEREAS, said verified application constitutes a request
provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 11th day of
February, 1981, hold a duly noticed public hearing as prescri
by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considl
all testimony and arguments, if any, of all persons desiring
heard, said Commission considered all factors relating to V-3
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public heari the Commission DENIES V-319, based on the following find

1) That there are no exceptional or extraordinary circumsta. or conditions applicable to the property that do not app
generally to other property in the same vicinity and zonl for the reasons stated in the staff report.
2) That such variance is not necessary for the preservation
and enjoyment of a substantial property right possessed :
