PLANNING COMMISSION RESOLUTION NO. '17.76
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING THE
CREATION OF ONE PANHANDLE LOT AS PART OF A
MINOR SUBDIVISION LOCATED ON THE EAST SIDE OF
HIGHLAND DRIVE BETWEEN HOOVER STREET AND ADAMS
STREET IN THE R-1-15,000 ZONE. APPLICANT: LUNDEEN CASE NO: MS-514
WHEREAS, a verified application for certain property, tc
Lot 7 in Block "E" of Bella Vista, in the city of
Carlsbad, according to map thereof No. 2152, filed
in the Office of the County Recorder, March 7, 1929
WHEREAS, said application constitutes a request as provi
by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Carlsbad Municipal Code, Section 21.10.080
provides that any panhandle lots within a minor subdivision r
approved by the Planning Commission; and
WHEREAS, the Planning Commission did on the 25th day of
February, 1981, hold a hearing as prescribed by law to consic
said request; and
WHEREAS, at said hearing, upon hearing and considering i
testimony and arguments, if any, of all persons desiring to 1:
heard, said Commission considered all factors relating to thc
Minor Subdivision; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the hearing,
the Commission recommends approval of MS-514 based on tl following findings and subject to the following conditic
Findings:
1) The property cannot be served adequately with a public I without a panhandle lot due to unfavorable conditions rt from the lot's topography and configuration.

1 2) Approval of a panhandle lot will not preclude or
adversely affect the ability to provide full public stree
2 access to other properties within the same block.

3) The proposed subdivision is consistent with all elements
the city's General Plan, including the land use element ~i
designates this site for low-medium density residential
development at 0-4 du/acre.
4) The proposed project will not result in any adverse envi~ mental impacts and it has been found to be exempt from tl
Carlsbad Environmental Protection Ordinance per Section 19.04.070(f)(4c and 4d), which specifically exempts panh;
lots in the R-1 zones in developed areas.
5) The project is consistent with all city public facility
policies and ordinances, and with Title 21 of the City's Municipal Code.
Conditions:
1) Approval is granted for MS-514 as shown on Exhibit "A", ( January 15, 1981, incorporated by reference and on file : the Planning Department. Development shall occur
substantially as shown unless otherwise noted in these conditions.
2) The panhandle lot shall have three non-tandem parking Spi
with an approach not less than 24 feet in length with a 1 turnaround area to permit complete turnaround for forwarr access to the street. Said parking and turnaround shall
subject to the approval of the City Engineer.
3) Structures permitted in the access portion of the lot sh limited to mailboxes, fences, trash enclosures, landscap# containers and nameplates. Except for mailboxes, the st shall not be greater than forty-two inches in height if located within twenty feet of the street property line o greater than six feet in height beyond this point.

21 4) The property owner of the panhandle lot shall agree to hi

6) The buildable portion of the panhandle lot shall be all

7) The developer shall obtain a grading permit prior to the commencement of any clearing or grading of the site.
8) Additional drainage easements and drainage structures sha
be provided or installed as may be required by the County
Department of Sanitation and Flood Control or the City
Engineer.
5 9) The applicant shall upgrade the existing fire hydrant, to
south of. the property prior to occupancy of any new build 6 on any of the newly created lots.
7 10) A13 conditions of the tentative parcel map' for MS-514 app
8 by the Engineering Department are incorporated herein by
reference and shall be complied with in their entirety.
9 PASSED, APPROVED AND ADOPTED at a regular meeting of the

the 25th day of February, 1981, by the following vote, to wit: 11
