HomeMy WebLinkAbout1981-03-25; Planning Commission; Resolution 1784# -5 .\. - 1 2 3 4 5 6 7 8 9 10 11 12 e e PLANNING COMMISSION RESOLUTION NO. 1784 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW THE SALE AND CONSUMPTION OF ALCOHOLIC BEVERAGES ON PROPERTY GENERALLY LOCATED ON THE SOUTHWEST CORNER OF EL CAMINO REAL AND PALOMAR AIRPORT ROAD. APPLICANT: VALLAS CASE NO: CUP-186 WHEREAS, a verified application has been filed with the city of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Cod the Planning Commission did, on the 11th day of March, 1981, I1 on the 25th day of March, 1981, hold a duly noticed public he 13 14 15 16 1N to consider said application on property described as: That portion of Palomar Airport in Lot "G" of Rancho Agua Hedionda, County of San Diego, according to Ma? No. 832. WHEREAS, at said public hearing, upon hearing and consid .t.r 18 all testimony and arguments, if any, of all persons desiring heard, said Commission considered all factors relating to CUP 19 ~ NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 20 21 22 23 25 24 the Commission APPROVES CUP-186, based on the following development of the community, is essentially in harmony 26 with the various elements and objectives of the general 27 plan, and is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed 28 use is to be located for the reasons stated in the staff report. Commission of the city of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public heari findings and subject to the following conditions: Findings: 1) That the requested use is necessary or desirable for the I1 4-.* .. - * e 1 2) That the site for the intended use is adequate in size and shape to accommodate the use for the reasons stated 2 in the staff report. 3 3) That all of the yards, setbacks, walls, fences, landscap: will be provided and maintained. and other features necessary to adjust the requested use 4 to existing or permitted future uses in the neighborhood 5 4) That as conditioned, the street system serving the propo: 6 use is adequate to properly handle all traffic generated the proposed use for the reasons stated in the staff rep( 7 8 Conditions: 1) Approval of CUP-186 is granted subject to approval of 9 by reference and shall be complied with in their entiret! 11 Zone Change 223 by the City Council and approval of SDP : by the Planning Commission, 10 2) All conditions of approval of SDP 80-13 are incorporated 12 13 14 15 16 17 18 19 20 21 22 23 3) The applicant shall obtain all necessary approvals from the Alcoholic Beverage Board prior to commencement of th: PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held the 25th day of March, 1981, by the following vote, to wit: AYES: Chairman Marcus, Commissioners Jose, Friestedt, La Rombotis, L'Heureux, and Leeds.
