A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING DENIAL OF A TENTATIVE SUBDIVISION MAP AND CONDOMINIUM PERMIT TC
DEVELOP 40 UNITS ON PROPERTY GENERALLY LOCATED ON THE
NORTH SIDE OF OCEAN STREET BETWEEN THE AT&SF RAILROAI AND THE PACIFIC OCEAN. APPLICANT: NATIVE SUN INVESTMENT GROUP

6 )I WHEREAS, a verified application for certain

All that portion of Lot 2 and a portion of Lot 3,
Section 1, Township 12 South, Ranges west, San
Bernardino Meridian, in the city of Carlsbad, accord:
10 to official plat thereof, lying southwesterly of the AT&SF Railway.
11 has been filed with the city of Carlsbad, and referred to

13 /I WHEREAS, said verified application constitutes a

WHEREAS, the Planning Commission did, on the 11th da;
of March, 1981, hold a duly noticed public hearing and a
continued public hearing on March 25, 1981, as prescribed by
19 I1 jito consider said request; and
2o 11 WHEREAS, at said public hearing, upon hearing and 2111 considering all testimony and arguments, if any, of all perso. 22/i desiring to be heard, said Commission considered all factors 2311 relating to the Tentative Tract Map and Condominium Permit.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannin

26 A) That the above recitations are true and correct.
27 B) That based on the evidence presented at the public heari

Findings:
1) The project as designed is inconsistent with the existir R-3 and R-A zoning on the property.

2) Because of the inconsistency with the existing zoning, t
site is not physically suitable for the type of developn
being proposed because of the environmental problems wit development on the lower portion of the property as indicated by the Environmental Impact Report (EIR 80-4)
reviewed in conjunction with the project and the commenl
made at the public hearing.
PASSED, APPROVED AND ADOPTED at a regular meeting of
a the Planning Commission of the city of Carlsbad, California,
held on the 1st day of April, 1981, by the following vote, tc 9
