HomeMy WebLinkAbout1981-04-22; Planning Commission; Resolution 1799I fL, e e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 1799 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A 10 UNIT TENTATIVE TRACT MAP AND CONDOMINIUM PERMIT ON PROPERTY GENERALLY LOCATED ON THE WEST SIDE OF SANTA ISABEL STREET APPLICANT: WALTON CASE NO: CT-81-8/CP-151 WHEREAS, a verified application for certain property wit: Lot 410 of La Costa Meadows Unit 2 according to Map 6 filed April 21, 1971 has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application constitutes a requ as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, at said public hearing, upon hearing and con sidering all testimony and arguments, if any, of all persons d siring to be heard, said Commission considered all factors re1 ting to the Tentative Tract Map and Condominium Permit. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planninc Commission as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearin the Commission recommends APPROVAL of CT-81-8/CP 151, bas on the following findings and subject to the following cc ditions: Findings: 1) The project is consistent with the city's General Plan si the proposed density of 18.2 du' s/acre is within the dens range of 10-20 du's/acre specified for the site as indica on the Land Use Element of the General Plan and can be ju tified for the reasons stated in the staff report. //// //// II ,T., <, a 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 I 20 21 22 23 24 25 26 27 28 2) The site is physically suitable for the type and density the development since the site is adequate in size and sk: to accommodate residential development at the density prc posed and still meet all of the requirements of the Condc minium Ordinance. 3) The project is consistent with all city public facility L: icies and ordinances since: a) The applicant has received 10 edu's from the Leucadia County Water District. b) The Planning Commission has, by inclusion of an apprc priate condition to this condominium permit and tent? tive subdivision map, insured that the final map will not be approved unless the City Council finds that se service is available to serve the project. In additi the Planning Commission has added a condition that a note shall be placed on the final map that building F nits nay not be issued for the condominium project un less the City Ehgineer determines that sewer service available, and building cannot occur within the proje unless sewer service remains available, the Planning Commission is satisfied that the requirements of the public facilities element of the General Plan have be met insofar as they apply to sewer service for this t tataive map and condominium permit approval. c) School facilities will be provided by the San Marcos School District. d) Park-in-lieu fees are requiired as a condition of apy Val. e) All necessary public improvements have been provided will be required as conditions of approval. f) The applicant has agreed and is required by the inclu ion of an appropriate condition to pay a public facil ties fee. Performance of that contract and payment o the fee will enable this body to find that public fac ities will be available concurrent with need as requi by the General Plan. 4) The land included within this project contains less than five acres, each parcel abutts upon a maintained public street and no dedications or improvements are required. Therefore, in accordance with Section 20.20.050(1) of the Carlsbad Municipal Code and Section 66426( d) of the Subdivision Map Act, a parcel map may be filed in lieu of final map. 5) The proposed project is compatible with the surrounding 1 use since the other properties along the south and west s PC RES0 #1799 -2- I .' ., a a 1 2 3 4 5 I 6 7 8 9 of Santa Isabel Street are being developed at a similar d sity and the surrounding area has also been designated fo medium-high density residential development. 6) This project will not cause any significant environmental impacts, and a Negative Declaration has been issued by th Planning Director on Mach 25, 1981 and approved by the Planning Commission on April 22, 1981. General Conditions 1) Approval is granted for CT-81-8/CP-151, as shown on Exhik I'A''''DI' dated March 5, 1981, incorporated by reference and file in the Planning Department. Development shall OCCUL substantially as shown unless otherwise noted in these cc ditions. 10 11 2) 12 13 14 15 16 18 17 3) 4) 19 I 20 21 I This project is approved upon the express condition that final map shall not be approved unless the City Council finds as of the time of such approval that sewer service available to serve the subdivision. This project is approved upon the express condition that building permits will not be issued for development of th subject property unless the City Ehgineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This note shall be placed on th final map. This project is approved upon the express condition that applicant shall pay a public facilities fee as required b City Council Policy No 17, dated August 29, 1979, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant payment of said fee a copy of that agreement dated Februa 24, 1981, is on file with the City Clerk and incorporated herein by reference. If said fee is not paid as promised this application will not be consistent with the General Plan and approval for this project shall be void. 22 Planning Department II 23 24 25 26 27 28 5) The applicant shall prepare a reproducible mylar of the final condominium site plan incorporating the conditions contained herein. Said site plan shall be submitted to a approved by the Planning Director prior to the issuance o building permits. This plan shall not exceed 24" x 36" i size. 6) The applicant shall prepare a detailed landscape and irri tion plan which shall be submitted to and approved by the Planning Director prior to final map approval. Sa CC&R's shall be submitted to and approved by the Planning Department prior to final map approval. 8) The applicant shall pay park-in-lieu fees to the city, pr to the approval of the final map as required by Chapter 20.44 of the Carlsbad Municipal Code. 9) The applicant shall provide school fees to mitigate condi tions of overcrowding as part of building permit applica- tion. These fees shall be based on the fee schedule in effect at the time of building permit application. 10) Any signs proposed for this developpment shall be designe in conformance with the city's Sign Ordinance and shall r quire review and approval of the Planning Department pric to installation of such signs. 11) All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. 12) Trash receptacle areas shall be enclosed by a 6 foot higk masonry wall with gates pursuant to city standards. Loca tion of said receptacles shall be approved by the Plannin Director. 13) All roof appurtenances, including air conditioners, shall architecturally integrated and shielded from view and the sound buffered from adjacent properties and streets to tk. satisfaction of the Planning Department and Building Dire tor. 14) Approval of this request shall not excuse compliance wit? all sections of the Zoning Ordinance and all other appli- cable city ordinances in effect at time of building permi issuance. 15) Concrete wheel stops shall be provided two and one-half f from the end of each parking stall.
