HomeMy WebLinkAbout1981-04-22; Planning Commission; Resolution 1800.. , ~ L 9 e @ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 1 20 21 22 23 24 25 26 27 PLANNING COMMISSION RESOLUTION NO. 1800 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A VARIANCE TO REDUCE THE BUILDING SETBACK FROM A PRIVATE DRIVEWAY FROM 5-FEET TO ZERO-FEET ON PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE OF CHINQUAPIN BETWEEN GARFIELD STREET, AND THE AT&SF RAILWAY IN THE RD-M ZONE. APPLICANT : NERLINGER CASE NO: V-322 WHEREAS, a verified application for certain property, to wit: The northeasterly 50.56 feet of Lot 5 in Block T according to Map 1803 filed August 25, 1974. has been filed with the city of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code: and WHEREAS, the Planning Commission did, on the 22nd day of April, 1981, hold a duly noticed public hearing as prescribed by law to consider said request: and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to V-322. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the city of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commission APPROVES V-322, based on the following findings: ///I 28 ///I ' c rL - .. 0 e 1 Findings: /I 2 3 4 5 6 1) 2) That there are exceptional or extraordinary circumstances applicable to this property that do not apply generally to other property in the same vicinity and zone for the reasons stated in the staff report. That the subject property is being denied a substantial property right possessed by other property in the same vicinity and zone for the reasons stated in the staff report. 7 8 3) That the granting of such variance would not be injurious to other property in the vicinity and that such materially detrimental to the public welfare and variance will not adversely affect the General Plan for 9 the reasons stated in the staff report. 10 PASSED, APPROVED AND ADOPTED at a regular 11 California, held on the 22nd day of April, 1981, by the 12 meeting of the Planning Commission of the city of Carlsbad, following vote, to wit: 13 14 15 16 17 18 19 I 20 21 AYES: Chairman Marcus, Commissioners Rombotis, Farrow, NoES : None.
