HomeMy WebLinkAbout1981-06-24; Planning Commission; Resolution 1810<' .- I o ,, .' e e 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 PLANNING COMMISSION RESOLUTION NO. 1810 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A 115 UNIT INDUSTRIAL TENTATIVE TRACT MAP ON 559.4 ACRES GENERALLY LOCATED WEST OF EL CAMINO REAL AND NORTH OF PALO- MAR AIRPORT APPLICANT: KOLL COMPANY CASE NO: CT 81-10 WHEREAS, a verified application for certain property, to wit: Lots "F" and "GI' of Rancho Agua Hedionda according to Ma- filed November 16, 1896 in the office of the County Recol of San Diego County, has been filed with the City of Carlsbad, and referred to tht Planning Commission; and WHEREAS, said verified application constitutes a request provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 27th day of 1981, hold a duly noticed public hearing and a continued pub: hearing on June 24, 1981, as prescribed by law, to consider I 18 1 request; and WHEREAS, at said public hearing, upon hearing and considc 19 I 20 21 22 23 24 25 26 27 all testimony and arguments, if any, of all persons desiring be heard, said Commission considered all factors relating to Tentative Tract Map. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Con sion as follows: (A) That the foregoing recitations are true and correct. (B) That based on the evidence presented at the public hearir the Commission recommends APPROVAL of CT-81-10, to the Cj Council, based on the following findings and subject to t following conditions: 2% //// I/ ., *' 0 e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 I 20 21 22 23 24 25 26 27 28 II Find inq s d 1) The site is physically suitable for the type and density the development since the site is adequate in size and s to accommodate industrial and commercial development and still meet all of the requirements of the Subdivision Orl nance. 2) The project is consistent with all city public facility cies and ordinances since: a) The Planning Commission has, by inclusion of an app priate condition to this tentative subdivision map, sured that the final map will not be approved unles City Council finds that sewer service is available serve the project. In addition, the Planning Commi has added a condition that a note shall be placed 01 final map that building permits may not be issued fc the project unless the City Engineer determines tha' sewer service is available, and building cannot occl within the project unless sewer service remains available, the Planning Commission is satisfied tha. requirements of the public facilities element of thc General Plan have been met insofar as they apply to sewer service for this tentative map approval. b) All necessary public improvements have been providec will be required as conditions of approval. c) The applicant has agreed and is required by the inc. sion of an appropriate condition to pay a public fa1 ties fee. Performance of that contract and payment the fee will enable this body to find that public f, ities will be available concurrent with need as reql by the General Plan. 3) The proposed project is compatible with the surrounding uses for the reasons stated in the staff report. 4) This project will not cause any significant environmenta: impacts, and a Negative Declaration has been issued by tl Planning Director on May 1, 1981 and approved by the Plar Commission on June 4, 1981. 5) The proposed subdivision is consistent with the city's (3 era1 Plan and with the Specific Plan approved on this si1 for the reasons stated in the staff report. 6) The design of the subdivision and type of improvements w: not conflict with easements for public use or public accf through the subject property. //// //// PC RES0 81810 -2- . I, I/ 0 0 I/ 1 General Conditions ll 2 4 3 1) 5 6 2) 7 a 3) 9 10 11 12 13 14 15 4) Approval is granted for CT 81-10, as shown on Exhibit A, dated May 6, 1981, incorporated by reference and on file the Planning Department. Development shall occur substa: ally as shown unless otherwise noted in these conditions. This project is approved upon the express condition that final map shall not be approved unless the City Council f as of the time of such approval that sewer service is ava able to serve the subdivision. This project is approved upon the express condition that building permits will not be issued for development of th subject property unless the City Engineer determines that sewer facilities are available at the time of application such sewer permits and will continue to be available unti time of occupancy. This project is approved upon the express condition that applicant shall pay a public facilities fee as required b City Council Policy No. 17, dated August 29, 1979, on fi with the City Clerk and incorporated herein by reference, according to the agreement executed by the applicant for ment of said fee a copy of that agreement dated June 25, 1980, is on file with the City Clerk and incorporated her by reference. If said fee is not paid as promised, this plication will not be consistent with the General Plan an approval for this project shall be void. 16 17 18 19 20 21 22 23 24 25 26 I 5) Approval of this request shall not excuse compliance with sections of the Zoning Ordinance and all other applicable city ordinances in effect at time of building permit issu ance . 6) The applicant shall establish an owner's association and responding covenants, conditions and restrictions or a maintenance district if approved by the City Council. SE association or maintenance district shall be responsible maintenance of all private common areas. Said CC&R's sha be submitted to and approved by the Planning Director pri to final map approval of Phase I. I' a e 1 2 3 4 5 6 i 8) The project shall provide bus stop facilities at location, subject to the satisfaction of the North County Transit D trict. Said facilities shall at a minimum include a benc' free from advertising and a pole for the bus stop sign, bench and pole shall be designed in a manner so as to not detract from the basic architectural theme of the project said design shall be subject to the approval of the Plann Director and North County Transit District. 9) Approval of Tentative Tract No. CT 81-10 is granted subje to approval of Zone Change 236. '7 8 10) The developer shall submit a detailed map showing propose locations for the mini-parks required pursuant to the ap- proved Specific Plan on the property. Said locations sha be approved by the Planning Director prior to final map a 9 proval of Phase I. 10 11 11) The street alignment of that street located between Lots and 5, 6 of Phase 4 shall be redesigned to allow more con ient access to the adjacent property to the east. Plans said realignment shall be submitted to and approved by th 12 City Engineer prior to final map approval of Phase 4. 13 14 15 16 17 18 19 20 12) The applicant shall grant an appropriate easement to the isfaction of the Planning Director, and approved by the C Attorney, for those portions of the subject property loca within an airport noise impact area as defined by the SAN Land Use Plan for Palomar Airport or updates thereto ensu that the city will not be held responsible for airport re ted noise impacts, A note identifying the noise impacts shall be placed on the final map. 13) The approval of this map shall expire eighteen months frc the date of City Council approval. The applicant may reg an extension and such extension may be approved or denied the discretion of the City Council. In approving an exte sion, the City Council may impose new conditions and may vise existing conditions. 21 23 14) The developer shall obtain a grading permit prior to the 22 Eng ineer ing Department commencement of any clearing or grading of the site. 24 //// 25 // //// 26 27 //// //// 28 //// PC RES0 # 1810 -4- I1 - 3. e a 1 15) The grading for this project is defined as "controlled gr; ing" by Section 11,06,17O(a) of the Carlsbad Municipal Col engineer whose responsibility it shall be to coordinate s the approved grading plan, submit required reports to the Carlsbad Municipal Code. 2 4 inspection and testing to insure compliance of the work w 3 Grading shall be performed under the observation of a civ City Engineer and verify compliance with Chapter 11.06 of 5 6 7 8 9 10 16) Upon completion of grading, the developer shall insure th an "as-graded" geologic plan shall be submitted to the Ci Engineer. The plan shall clearly show all the geology as exposed by the grading operation, all geologic corrective measures as actually constructed and must be based on a cs tour map which represents both the pre and post site grad This plan shall be signed by both the soils engineer and engineering geologist. The plan shall be prepared on a m or similar drafting film and shall become a permanent re- cord. 11 17) No Grading shall occur outside the limits of the subdivis unless a letter of permission is obtained from the owners 12 the affected properties. 13 14 15 16 17 18) Additional drainage easements and drainage structures sha be provided or installed as may be required by the County Department of Sanitation and Flood Control or the City En neer. 19) The developer shall pay the current local drainage area f prior to approval of the final map or shall construct dra age systems in conformance with the Master Drainage Plan City of Carlsbad Standards as required by the City Engine 18 I 19 1 20) 20 21 22 23 24 25 26 27 21 1 22 1 Land for all public streets and easements shown on the te tive map shall be dedicated on the final map and shall be granted to city free and clear of all liens and encumber- ances. Direct access rights for all lots abutting El Camino Real College Boulevard (Street A) shall be waived on the final map . Except as stated below, all public streets within a phase shall be improved by the developer based on the typical s tions shown on the tentative map and in conformance with of Carlsbad Standards prior to occupancy of any buildings within that phase. Street improvements shall include sid walks along all frontages, street lights, street trees, 1 foot median on College Boulevard and a 9-foot half width ian on El Camino Real. The median islands may be waived the City Council modifies their policy relating to street improvements. 28 //// PC RES0 #1810 -5- I ._ . L' 0 e 1 2 3 4 5 6 7 23) College Boulevard shall be dedicated - based on a right-oj way width of 102 feet - from El Camino Real to the southel tract boundary at the time of approval of the final map fc Phase 11. Fifty-two (52) feet shall be dedicated for Col: Boulevard, based on an ultimate right-of-way width of 102 feet, from the southern tract boundary to Palomar Airport Road at the time of approval of the final map for Phase I: The City Engineer may, at his discretion, approve another connection between the project site and Palomar Airport Rc provided that the other connection provides for adequate ( I culation and also provided that if this other connection I approved, College Boulevard shall be constructed in conjul I tion with adjacent development . 8 9 24) College Boulevard shall be constructed to a minimum width 10 Road prior to the occupancy of any buildings in Phase 11, 32 feet of pavement from El Camino Real to Palomar Airpor. or Iv, whichever occurs first. 11 12 13 14 25 1 The developer shall enter into a traffic signal agreement post a bond for one-half the cost of a fully actuated tra signal at the intersection of El Camino Real and Street 'I' prior to approval of the final map for Phase I. The deve oper shall install this signal prior to the issuance of building permits for any buildings in Phase I. The other half of the cost of the signal shall be borne by the city through appropriate fees and/or agreements. I.5 26) The developer shall enter into traffic signal agreements 16 17 18 19 1 27) The developer shall comply with all the rules, regulation and design requirements of the respective sewer and water 20 agencies regarding services to the project. 21 28) All concrete terrace drains shall be maintained by the pr perty owner's association or the individual property owne 22 An approximately worded statement clearly identifying thi responsibility shall be placed in the CC&R's. 23 24 25 26 post bonds for fully actuated traffic signals at the inte sections of Street 'rB1' and College Boulevard (Street "A") prior to approval of the final map for Phase I1 and Stree "N" and College Boulevard prior to approval of the final : for Phase 111. 29) Street "B" west of Street "A" shall be connected to anoth city street (to provide a second exit from the area), sub to the approval of the City Engineer and Fire Chief, prio the issuance of a building permit for any buildings on lo 18 through 38 of Phase IV. '> L +' e e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 I 21 22 Fire Department 30) Prior to the issuance of building permits, complete build plans shall be submitted to the Fire Department for revie and approval. 31) The applicant shall submit two (2) copies of a site plan showing locations of existing and proposed fire hydrants on-site roads and drives. 32) An all weather access road shall be maintained throughout construction. 33) Water for fire protection shall be available to the site i the satisfaction of the Fire Marshall before combustibles placed on the building site. 34) All fire alarm systems, fire hydrants, extinguishing systc automatic sprinklers, and other systems pertinent to the 1 ject shall be submitted to the Fire Department for approvl prior to construction. 35) All roof top appurtenances shall be architecturally inte- grated into the design on the building and shielding to p: vent noise and visual impacts, subject to approval before issuance of permit. Parks Department 36) The median islands along El Camino Real running along the length of this property shall be landscaped per city stan- dards. The median islands may be waived if the City Counc modifies their policy relating to street improvements. 37) Street trees shall be installed throughout the project pu~ suant to city standards. The types and locations of said Recreation Department.
