HomeMy WebLinkAbout1981-06-24; Planning Commission; Resolution 1824fq ' ,z e e I II PLANNING COMMISSION RESOLUTION NO. 1824 2 3 4 5 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A CONDITIONA: USE PERMIT TO ALLOW A DRIVE-THRU BANKING FACILITY ON PROPERTY GENERALLY LOCATED ON THE NORTHEAST CORNER 0 ELM AVENUE AND MADISON STREET. APPLICANT: HOME SAVINGS AND LOAN CASE NO: CUP-202 6 city of Carlsbad and referred to the Planning Commisison; and 7 WHEREAS, a verified application has been filed with a WHEREAS, said verified application constitutes a req 9 provided by Title 21 of the Carlsbad Municipal Code; and 10 WHEREAS, pursuant to the provisions of the Municipal 11 described as: 13 duly noticed public hearing to consider said application on p' 12 the Planning Commission did, on the 24th day of June, 1981, hc 14 15 Lots 1 thru 6 inclusive, Block 49, Town of Carlsbad, city of Carlsbad, according to Map thereof No. 535 f May 2, 1888 16 considering all testimony and arguments, if any, of all persol 17 WHEREAS, at said public hearing, upon hearing and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannins 20 1 relating to CUP-202. 19 desiring to be heard, said Commission considered all factors 18 23. Since the project cannot be approved unless sewer service is available, and building cannot occur within the projc unless sewer service remains available, the Planning Commission is satisfied that the requirements of the facilities element of the general plan have been met insofar as they apply to sewer service for this projc b) All necessary public improvements have been provided will be required as conditions of approval. c) The applicant has agreed and is required by the incll of an appropriate condition to pay a public facilitic Performance of that contract and payment of the fee t enable this body to find that public facilities will available concurrent with need as required by the Ger Plan. General Conditions 1) Approval is granted for CUP-202, as shown on Exhibits A-E May 7, 1981, incorporated by reference and on file in the Planning Department. This conditional use permit shall be reviewed by t Planning Director on a yearly basis to determine if all co tions of this permit have been met and that the use does nl a significant detrimental impact on surrounding properties public health and welfare. If the Planning Director deter, that the use has such significant adverse impacts, the dir' shall recommend that the Planning Commission, after provid permittee the opportunity to be heard, add additional cond to mitigate the significant adverse impacts. This permit revoked at any time after a public hearing, if it is found the use has a significant detrimental affect on surroundin uses and the public's health and welfare or the conditions posed herein have not been met. This permit may be extend a reasonable period of time not to exceed five years upon application of the permittee made not less than 90 days pr the expiration date. In granting such extension, the Plan Commission shall find that no substantial adverse affect o rounding land uses or the public's health and welfare will because of the continuation of the permitted use. If a su tial adverse affect on surrounding land uses or the public health and welfare is found, the extension shall be consid an original application for a conditional use permit.
