A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A REQUEST
FOR AN EIGHT FOOT HIGH FENCE ON PROPERTY
GENERALLY LOCATED ON THE NORTH SIDE OF PINE
AVENUE BETWEEN PI0 PIC0 DRIVE AND HIGHLAND
AVENUE : FPPLICANT : MUSSER

5 WHEREAS, a verified application for certain property

A portion of the southeasterly 140 feet of Lots 6 and 7 of the subdivision of Tract 114
and 120 of Carlsbad Lands according to Map
1744 filed January 3, 1923
has been filed with the City of Carlsbad and referred to the
Planning Cornmission; and
WHEREAS, said verified application constitutes a
request as provided by Title 21 of the Carlsbad Municipal Cod
and
WHEREAS, the Planning Commission did, on the 8th day
July, 1981, consider said request; and \
WHEREAS, at said hearing, upon hearing and consideri,
all testimony and arguments, if any, of all persons desiring
be heard, said Commission considered all factors relating to
Planning Commission determination; I
MOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannin? 21

Commission as follows:
A. That the foregoing recitations are true and correct.
B. That based on the evidence presented at the public hearir
the Commission APPROVES PCD-30, based on the following findin!
and subject to the following conditions:

That the proposed fence would not have an adverse effec.
the surrounding properties because the open wire design
the fence interwoven with the foliage as proposed will I
create a severe visual impact on adjacent properties.
That construction of the fence to an eight foot height v intregrate the fence with structures existing on the property and on the adjoining property.
That the eight foot fence will act as a buffer between t
single family residential property on the site and the 1 density multi-family residential structure abutting the rear of the property.

4. That when planted with foliage the proposed eight foot
fence will act as a screen to buffer the property from t
freeway noise.
Conditions:
1. That the fence shall be of open wire construction and th
no solid or semi-solid wall shall be allowed.
2. That the area ajoining the fence shall be immediately
planted with foliage which is of such a nature as to cli and weave throughout the fence.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
1511 Planning Commission of the City of Carlsbad, California, held
