HomeMy WebLinkAbout1981-07-08; Planning Commission; Resolution 1828- .. 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 I 20 21 22 23 24 25 26 27 28 I PLANNING COMMISSION RESOLUTION NO. 1828 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A PLANNING COMMISSION DETERMINATION TO RELOCATE AN OFFICE BUILDING FROM ITS EXISTING LOCATION, ONE LOT SOUTH, TO PROPERTY GENERALLY LOCATED ON THE EAST SIDE OF HARDING STREET BETWEEN ELM AVENUE AND OAK AVENUE APPLICANT: FREEHOF CASE NO: PCD-3 1 WHEREAS, a verified application for certain property, to 1 Lot 9 and 10 in Block 66 of Carlsbad Subdivision accordin! to map 535 filed May 21, 1888. has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request i provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 8th day of Ju: 1981, consider said request; and WHEREAS, at said hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring I be heard, said Commission considered all factors relating to i Planning Commission Determination; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: (A) That the foregoing recitations are true and correct. (B) That based on the evidence presented at the public hearin! the Commission APPROVES PCD-31, based on the following findings and subject to the following conditions: //// //// //// //// APN 203-353-04 - .IC+ e e .. . A II 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 I 20 21 22 23 24 Findings 1) That the proposed building relocation and use would be cc sistent with all applicable zoning requirements, as discussec in the staff report. 2) That the proposed building relocation and use would be cc patible with surrounding land uses, as discussed in the staff report . 3) That the Planning Director has determined that this projc is categorically exempt from environmental review per Section 19.04.070(L) of the Carlsbad Municipal Code. Cond it ions 1) Approval is granted for PCD-31, as shown on Exhibit A, dated June 4, 1981, incorporated by reference and on file the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. 2) Approval of this request shall not excuse compliance witk sections of the Zoning Ordinance and all other applicable city ordinances in effect at time of building permit issuance. PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held the 8th day of July, 1981, by the following vote, to wit: AYES: Vice-chairman Friestedt, Commissioners Rombotis, Farrow, Schlehuber, Jose and L'Heureux.
