PLANNING COMMISSION RESOLUTION NO. 1814
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A CONDITIONAL USE
PERMIT REQUEST TO CONSTRUCT MODULAR OFFICE STRUCTURE: ON THE SOUTH SIDE OF LAGUNA DRIVE, BUT DENYING THE REQUEST TO CONSTRUCT A TEMPORARY PAVED PARKING LOT OJ!
THE NORTH SIDE OF LAGUNA DRIVE BETWEEN PI0 PIC0 DRIVI AND ELMWOOD STREET. APPL1CANT:CITY OF CARLSBAD CASE NO: CUP-1 98
WHEREAS, a verified application has been filed with the (
of Carlsbad and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request
provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Codt
the Planning Commission did, on the 22nd day of July, 1981, hc
duly noticed public hearing to consider said application on
property described as:

parking lot All that portion of the Northwest one quarter Section 6, Township 12 South, Range 4 West, San Bernardino Meridian the city of Carlsbad, County of San Diego, State of California, also known as assessors parcel nurnber.156-164 23.
WHEREAS, at said public hearing, upon hearing and
considering all testimony and arguments, if any, of all persol
desiring to be heard, said Commission considered all factors
relating to CUP-198.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the city of Carlsbad as follows:

A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public heari~
the Commission APPROVES CUP-198 for modular offices, but DENIES the request tor a temporary paved parking facilit: Laguna Street, based on the following findings and subjec
the following conditions:
Findings:
1) That approval of the Conditional use Permit for the modu: offices will not be detrimental to surrounding uses or tc uses specifically permitted in the zone.
2) That the site for the modular offices is adequate in sizl
shape to accommodate the use.
3) That all of the yards, setbacks, walls, fences, landscap and other features necessary to adjust the modular officc to existing or permitted future uses in the neighborhood
be provided and maintained.
4) That the street system serving the modular offices is ad1 quate to properly handle all traffic generated by the prc
posed use ,
5) That the request to construct a paved parking lot on the
north side of Laguna would be detrimental to surrounding residential uses located on Stratford Lane. Also, the proposed parking lot is not desirable to the development
the community and is not in harmony with the various elel and objectives of the General Plan for the following rea.

General. Conditions:
1) Approval is granted for CUP-198, for the proposed modula. Office uses only, as shown on Exhibit "A" dated, June 2,
1981, incorporated by reference and on file in the Plann Department. Development shall occur substantially as shc unless otherwise noted in these conditions,

2) Approval of this request shall not excuse compliance wit1
all sections of the Zoning Ordinance and all other applicable city ordinances in effect at the time of built
permit issuance.
3) This Conditional Use Permit shall expire five years from
date of this resolution or when permanent facilities are
completed, whichever occurs first, unless an extension ir
granted by the Planning Commission.
4) A final site plan for the modular structures, including placement, orientation and architectural treatment of
buildings as well as retention of any parking spaces, sh
be submitted to and approved by the Planning Director pr
to building permit issuance.
5) The applicant shall prepare a detailed landscape and irrigation plan for the project, which shall be submittel to and approved by the Planning Director prior to the issuance of grading or building permits.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Planning Commission of the city of Carlsbad, California, held
the 22nd day of July, 1981, by the following vote, to wit:
