HomeMy WebLinkAbout1981-07-22; Planning Commission; Resolution 18401 I .. 1 2 3 4 5 e e PLANNING COMMISSION RESOLUTION NO. 1840 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE CREATION OF TWO PAN- HANDLE LOTS AS PART OF A MINOR SUBDIVISION LOCATED ON THE WEST SIDE OF VALLEY STREET IN THE R-1-7500 ZONE, APPLICANT: JASMER CASE NO: MS-546 II WHEREAS, a verified application for certain property, to 1 6 7 A portion of Tract 128 of Carlsbad Lands, Map 1661 ii the City of Carlsbad, County of San Diego. 8 WHEREAS, said application constitutes a request as providc 9 by Title 21 of the Carlsbad Municipal Code; and 10 WHEREAS, the Carlsbad Municipal Code, Section 21.10.080 p' 11 1 Minor Subdivision; and 19 heard, said Commission considered all factors relating to the 18 testimony and arguments, if any, of all persons desiring to be 17 WHEREAS, at said hearing, upon hearing and considering a1 16 quest; and 15 1981, hold a hearing as prescribed by law to consider said re- 14 WHEREAS, the Planning Commission did on the 22nd day of J 13 approved by the Planning Commission; and 12 vides that any panhandle lots within a minor subdivision must 20 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 21 following findings and subject to the following condition 24 B) That based on the evidence presented at the hearing, the 23 A) That the foregoing recitations are true and correct. 22 Commission as follows: Commission recommends approval of MS-546 based on the 25 26 27 28 I Findings 1) The properties cannot be served adequately with a public street without panhandle lots due to unfavorable conditic resulting from the lot's configuration, /// Ii ..' q c - e e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 I 20 21 22 23 24 25 26 27 28 2) Subdivision with panhandle lots will not preclude or ad- versely affect the ability to provide full public street access to other properties within the same block. 3) The proposed subdivision is consistent with all elements the city's General Plan, including the land use element which designates this site for low-medium density resider development at 0-4 du/acre. 4) The proposed project will not result in adverse environmc tal impacts and, it has been found to be exempt from the Carlsbad Environmental Protection Ordinance per Section 19.04.070 (f) (4c and 4f), which specifically exempts par handle lots in the R-I zones in developed areas. 5) The project is consistent with all city public facility policies and ordinances, and with Title 21 of the City's Municipal Code. Conditions 1) Approval is granted for MS-546, as shown on Exhibit A, da July 9, 1981, incorporated by reference and on file in th Planning Department, Development shall occur substantial as shown unless otherwise noted in these conditions. 2) The panhandle lots shall each have three non-tandem parki spaces with an approach not less than 24 feet in length w a proper turnaround area to permit complete turnaround fo forward access to the street. Said parking and turnaroun shall be subject to the approval of the City Engineer. 3) Structures permitted in the access portion of the lots sh, be limited to mailboxes, fences, trash enclosures, landsc( containers and nameplates, Except for mailboxes, the str, tures shall not be greater than forty-two inches in heigh. if located within twenty feet of the street property line greater than six feet in height beyond this point. 4) Prior to final map approval, the property owners shall en. into an agreement to hold the city or any other public se: vice agency harmless from liability for any damage to the driveway when being used to perform a public service subjc to Planning Director and City Attorney approval. 5) The existing building on the subject property shall confol to the setback requirements of the R-1-7500 zone prior to final map approval. 6) All lots shall have a minimum depth of 90 feet. 7) The buildable portions of the panhandle lots shall be all portions of the lots that have width of greater than 35 feet. /// 2 I! 2.. . < ,L /I 1 2 3 4 5 1 e e 8) The front yard of lot B is defined as a line running nortk: to south along the easterly property line of said lot.
