PLANNING COMMISSION RESOLUTION NO. 1845
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A CONDI- TIONAL USE PERMIT TO CONSTRUCT A NEW SANCTUARY FOR
THE ST. PATRICK'S CHURCH ON PROPERTY GENERALLY
LOCATED ON THE NORTHWEST CORNER OF ADAMS STREET
AND TAMARACK AVENUE IN THE R-1 ZONE.
APPLICANT: ST. PATRICK'S ZONE CASE NO: CUP-204
WHEREAS, a verified application has been filed with the Ci
of Carlsbad and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request a
provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal code,
the Planning Commission did, on the 12th day of August, 1981,
hold a duly noticed Public Hearing to consider said applicatic
on property described as:
All that portion of Lot 236 of Thumlands in the City of
Carlsbad, according to Map thereof No. 1681, filed Decembe
9, 1913.
WHEREAS, at said hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be
heard, said Commission considered all factors relating to CUP-
204.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Comn
sion of the City of Carlsbad as follows:
(A) That the foregoing recitations are true and correct.
(B) That based on the evidence presented at the public hearins the Commission APPROVES CUP-204 , based on the following findings and subject to the following conditions:

1) That the proposed church is desireable for the developmer of the community, is essentially in harmony with the varj elements and objectives of the General Plan and is not de

1 rimental to existing uses or to uses specifically permitt in the R-1 zone. 2
2) That the subject site is adequate in size and shape to ac 3 comodate the proposed church.

3) That all the yards, setbacks, walls, fences, landscaping other features necessary to adjust the proposed church tc existing or permitted future uses in the neighborhood wil
be provided and maintained.
4) That the street system serving the proposed use is adequ;
to properly handle all traffic generated by the proposed
use. Also, the potential parking on Adams Street and Tar
rack Avenue will not create a detrimental impact on the (
culation system because the time of peak use for the chul
will not coincide with the time of peak traffic volumes c
Tamarack and Adams.
5) That the height of the proposed church spire, as conditic herein, will not cause significant adverse visual impact
surrounding properties.
6) That the project will not cause any significant environ-
mental impacts and a Negative Declaration has been issuec
the Planning Director on July 24, 1981 and approved by t1 Planning Commission on August 12, 1981.

1) Approval is granted for CUP-204, as shown on Exhibits "A
B", dated June 4, 1981, incorporated by reference and on file in the Planning Department. Development shall occt substantially as shown unless otherwise noted in these 18 conditions.

4) The applicant shall prepare a reproducible mylar of the final site plan incorporating the conditions contained herein. Said site plan shall be submitted to and approvc by the Planning Director prior to the issuance of buildir 28 permits.

5) All parking lot trees shall be a minimum of 15 gallons i! size.
6) The applicant shall prepare a detailed landscape and
irrigation plan which shall be submitted to and approved
the Planning Director prior to the issuance of building permits.
7) All landscaped areas shall be maintained in a healthy an1 thriving condition, free from weeds, trash, and debris.
8) Any signs proposed for this development shall be designe\ conformance with the city's Sign Ordinance and shall reqr
review and approval of the Planning Department prior to :
stallation of such signs.
9) Trash receptacle areas shall be enclosed by a 6 foot higl:
masonry wall with gates pursuant to city standards. Loci tion of said receptacles shall be approved by the Plannir Director.

11) Seven additional parking spaces shall be provided on-sitt meet the minimum parking requirements for a church use.
Such spaces shall be located subject to the approval of t Planning Director prior to the issuance of a building per and shall be shown on the reproducible mylar as required
condition no. 5.
12) The height of the church spire shall not exceed 60 feet E
measured from the finished floor level of the church.
Engineering, Department Conditions
13) The developer shall obtain a grading permit prior to the
commencement of any clearing or grading of the site.
14) The grading for this project is defined as "regular gradj by Section 11.06.170(a) of the Carlsbad Municipal Code.

shall include all required drainage structures and any re quired erosion control measures. The developer shall als
submit soils, geologic or compaction reports if required
shall comply with all provisions of Chapter 11.06 of the Carlsbad Municipal Code.
15) A strip of land approximately 9 feet wide shall be dedica along Tamarack Avenue. The dedication shall include a
20-foot property line radius at the intersection with Ada Street and a taper approximately 50 feet long to a width

dedication of 18 feet at the west property line. The lar
dedicated shall be subject to the approval of the City Er neer and shall be dedicated prior to the issuance of a
building permit.
16) All land and/or easements required by this project shall
granted to the city, without cost to the city, free and
clear of all liens and encumberances.
17) Direct access rights along Tamarack Avenue shall be waivf
by deed restriction prior to issuance of a building permj
,18) Tamarack Avenue shall be improved by the developer along
I subdivision frontage based on a centerline to curb face
width of 32 feet and in conformance with City of Carlsbac Standards prior to occupancy of any buildings. This conc tion may be fulfilled by entering into a future improveme agreement prior to the issuance of a building permit if E proved by the City Engineer.

The developer shall install a wheelchair ramp at the pub1
street corner abutting the subdivision in conformance wit City of Carlsbad Standards prior to occupancy of any buil ings.
The design of Tamarack Avenue is currently underway and t precise alignment is not known at this time. Therefore, improvements required may be revised or delayed by the PC ing of an appropriate bond if such is found necessary and approved by the City Engineer.
The developer shall comply with all the rules, regulation and design requirements of the respective sewer and water
agencies regarding services to the project.

PASSED, APPROVED AND ADOPTED at a regular meeting of the
Planning Commission of the City of Carlsbad, California, held
the 12th day of August, 1981, by the following vote, to wit:
AYES: Chairman Xarcus, Commissioners Rombotis, Schlehl
NOES : None.
ABSENT : Commissioners Farrow and L'Heureux.
