Development shall occur substantially as shown unless otherwise noted these conditions. 3) This project is approved upon the express condition that t final map shall not be approved unless the City Council fi as of the time of such approval that sewer service is avai able to serve the subdivision. 4) This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application such sewer permits and will continue to be available until time of occupancy. Planning Department Conditions 8) The applicant shall prepare a reproducible mylar of the f site plan incorporating the conditions contained herein. site plan shall be submitted to and approved by the Plann Director prior to the issuance of building permits. 9) The applicant shall establish a homeowner's association a] corresponding covenants, conditions and restrictions. Sa CC&R's shall be submitted to and approved by the Planning partment prior to final map approval. I1 PC RES0 NO. 1848 -3- .. /I e e 1 2 3 4. 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 I 20 21 22 23 24 25 26 27 28 10) The applicant shall prepare a detailed landscape and irrig tion plan which shall be submitted to and approved by the Planning Director prior to the issuance of building permit 11) All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. 12) Any signs proposed for this development shall be designed conformance with the city's Sign Ordinance and shall requi review and approval of the Planning Department prior to in stallation of such signs. 13) Trash receptacle areas shall be enclosed by a 6 foot high masonry wall with gates pursuant to city standards. Locat of said receptacles shall be approved by the Planning Dire tor. 14) All roof appurtenances, including air conditioners, shall architecturally integrated and shielded from view and the sound buffered from adjacent properties and streets to the satisfaction of the Planning Department and Building Direc tor. 15) All units shall provide space for laundry facilities to ac modate a washer and dryer. 16) Prior to occupancy of any units, the visitor parking space shall be signed and labeled to the satisfaction of the P1; ning Director . Engineering Conditions 17) The developer shall obtain a grading permit prior to the c mencement of any clearing or grading of the site. 18) The grading for this project is defined as "regular gradir by Section 11.06.170(a) of the Carlsbad Municipal Code. ! developer shall submit a grading plan for approval which shall include all required drainage structures and any re- quired erosion control measures. The developer shall alsc submit soils, geologic or compaction reports if required i shall comply with all provisions of Chapter 11.06 of the Carlsbad Municipal Code. 19) Lincoln Street shall be fully improved along the frontage this project prior to occupancy of any units subject to Engineering standards and City Engineer approval. 20) The sump pump shall be designed and located to the satisfi tion of the City Engineer. 21) Additional off-site drainage improvements shall be requirc if found necessary by the City Engineer to mitigate drain; impacts caused by this project on Walnut Avenue or adjace~ property . PC Reso No. 1848 -4- . . . ,- e * 1 Fire Department Conditions II 2 3 4 5 6 7 22) All private driveways shall be kept clear of parked vehicl' at all times and shall have posted "No Parking/Fire Lane/T' Away Zone" pursuant to Section 12.04.040 of the Municipal Code. 23) In order to provide for fire protection during the constru tion period, the applicant shall maintain passable vehicul access to all buildings. In addition, adequate fire hydra with required fire flows shall be installed on and off sit as required by the Fire Department. /I Parks and Recreation Department Conditions 8 9 10 11 12 13 14 15 16 17 24 ) The applicant shall install street trees to city specifica tions at 40 foot intervals along all public street frontag prior to final occupancy of any building. The variety of said trees shall be subject to the approval of the Parks a Recreation Department.
