APPLICANT: A & W VENTURES, INC. CASE NO: CT 81-23 ~- WHEREAS, a verified application for certain property, tc Parcels 2 and 3 shown at page 6328 of Parcel Maps, filec September 6, 1977 and a portion of Lot "I" of Rancho Agl Hedionda according to Map No. 823 filed November 16, 18! has been filed with the city of Carlsbad, and referred to thc ning Commission; and WHEREAS, said verified application constitutes a reques' provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 26th day 0: August, 1981, hold a duly noticed public hearing as prescribt law to consider said request; and WHEREAS, at said public hearing, upon hearing and consic all testimony and arguments, if any, of all persons desiring heard, said Commission considered all factors relating to thc ative Tract Map. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Cc sion as follows: A) That the above recitations are true and correct. Development shall occur substi ally as shown unless otherwise noted in these conditions 2) This project is approved upon the express condition that final map shall not be approved unless the City Council : as of the time of such approval that sewer service is av, able to serve the subdivision. 3) This project is approved upon the express condition that building permits will not be issued for development of tl subject property unless the City Engineer determines that sewer facilities are available at the time of applicatior such sewer permits and will continue to be available unt: time of occupancy. This note shall be placed on the fin; map. 4) This project is approved upon the express condition that applicant shall pay a public facilities fee as required 1 City Council Policy Yo. 17, dated August 29, 1979, on f: with the City Clerk and incorporated herein by reference, according to the agreement executed by the applicant for ment of said fee a copy of that agreement dated June 8, 1 is on file with the City Clerk and incorporated herein by ference. If said fee is not paid as promised, this appli tion will not be consistent with the General Plan and apF for this project shall be void. 5) The applicant shall pay park-in-lieu fees to the city, pr to the approval of the final map as required by Chapter 2 of the Carlsbad Municipal Code. 6) Approval of this request shall not excuse compliance witk sections of the Zoning Ordinance and all other applicable ordinances in effect at time of building permit issuance. Planning Department: 7) The applicant shall submit a street name list consistent the city's street name policy subject to the Planning Dir tor's approval prior to final map approval. 8) Lots 3-6 inclusive shall provide at least 3 on-site parki spaces per lot. Engineering Department: 9) A gravel bag barrier or other erosion control measures ap proved by the City Engineer shall be erected around the boundaries of the grading if any grading is done between November 16th and April 14th. The grading for this project is defined as "controlled g~ ing" by Section 11.06.170(a) of the Carlsbad Municipal Cc Grading shall be performed under the observation of a cil engineer whose responsibility it shall be to coordinate : inspection and testing to insure compliance of the work 1 the approved grading plan, submit required reports to thc Engineer and verify compliance with Chapter 11.06 of the Carlsbad Municipal Code. No Grading shall occur outside the limits of the subdivis unless a letter of permission is obtained from the owner: the affected properties. Additional drainage easements and drainage structures shi provided or installed as may be required by the County Dt ment of Sanitation and Flood Control or the City Engineel The developer shall pay the current local drainage area j prior to approval of the final map or shall construct dr: systems in conformance with the Master Drainage Plan and of Carlsbad Standards as required by the City Engineer. Land for all public streets and easements shown on the tc tive map shall be dedicated on the final map and shall be granted to city free and clear of all liens and encumber- ances.
