SDP 78-1(B), TO DEVELOP AN LNDUSTRIAL/OFFICE COMPLEX ON PROPERTY GENERALLY LOCATED OM THE EAST SIDE OF EL CAMINO REAL, NORTH OF PALMER WAY APPLICANT: HUBBARD CASE NO: SDP 78-1(B) WHEREAS, a verified application has been filed with the ( of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request i provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission approved Site Developmeni Plan SDP 78-1 with Resolution No. 1485, dated December 13, 19' and WHEREAS, pursuant to the provisions of the Nunicipal Code the Planning Commission did, on the 26th day of August, 1981, consider said request on property described as: A resubdivision of parcel 2 of parcel map No. 10060 filed the office of the County Recorder May 23, 1980. 18 Development Plan No. SDP 78-1(B). 21 heard, said Commission considered all factors relating to Sit 20 I testimony and arguments, if any, of all persons desiring to b 19 1 WHEREAS, at said hearing, upon hearing and considering a1 22 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 23 (R) That based on the evidence presented at the public hearir 25 (A) That the foregoing recitations are true and correct. 24 Commission of the City of Carlsbad as follows: the Commission APPROVES SDP 78-1(€3), based on the followi 26 findings and subject to the following conditions: 27 28 e e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 , Findings 1) The project is consistent with the city's General Plan si the proposed development is consistent with the P-I, Plan Industrial, land use designation specified for this prope by the General Plan. 2) The site is physically suitable for the type and density the development since the site is adequate in size and sh to accommodate the proposed development. 3) The project is consistent with all city public facility p icies and ordinances since: a) The Planning Commission has, by inclusion of an appro ate condition to this project, insured that building permits for the project will not be issued unless the City Engineer finds that sewer service is available tl serve the project. The Planning Commission is therefl satisfied that the requirements of the public facilit element of the General Plan have been met insofar as apply to sewer service for this project. b) All necessary public improvements have been provided will be required as conditions of approval. c) The applicant has agreed and is required by the inclu of an appropriate condition to pay a public facilitie fee. Performance of that contract and payment of the will enable this body to find that public facilities be available concurrent with need as required by the era1 Plan. d) Assurances have been given that adequate sewer for th project will be provided. 4) The proposed project is compatible with the surrounding f ture land uses since surrounding properties to the south west are designated for industrial development on the Genc Plan and a canyon separates the property from residential: designated property to the north. 5) This project as conditioned will not cause any significan. environmental impacts and a Conditional Negative Declarat. has been issued by the Planning Director on July 20, 1981 approved by the Planning Commission on August 26, 1981. Conditions of Approval General: 1) Approval is granted for SDP 78-1(B), as shown on Exhibit , dated 8/10/81 and Exhibits B and C, dated 3/13/81, incorpc ated by reference and on file in the Planning Department. Development shall occur substantially as shown unless othl wise noted in these conditions. I1 PC RES0 1854 -2- 9 e e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 I ~ 2) This project is approved upon the express condition that building permits will not be issued for development of tht subject property unless the City Engineer determines that sewer facilities are available at the time of application such sewer permits and will continue to be available unti: time of occupancy. 3) This project is approved upon the express condition that applicant shall pay a public facilities fee as required b: City Council Policy No. 17, dated August 29, 1979, on fill with the City Clerk and incorporated herein by reference, according to the agreement executed by the applicant for ; ment of said fee a copy of that agreement dated March 5, 1981, is on file with the City Clerk and incorporated her1 by reference. If said fee is not paid as promised, this plication will not be consistent with the General Plan an( approval for this project shall be void. 4) Approval of this request shall not excuse compliance with sections of the Zoning Ordinance and all other applicable city ordinances in effect at time of building permit issu ance 5) This approval shall become null and void if building perm are not issued for this project within one year from the I of project approval. Planning Department: 6) The applicant shall prepare a reproducible mylar of the f site plan incorporating the conditions contained herein. Said site plan shall be submitted to and approved by the Planning Department prior to the issuance of building permits. 7) The applicant shall prepare a detailed landscape and irri, tion plan which shall be submitted to and approved by the Planning Department prior to the issuance of building permits. 21 22 8) All parking lot trees shall be a minimum of 15 gallons in 24 thriving condition, free from weeds, trash, and debris. 23 IO) Any signs proposed for this development shall be designed conformance with the city's Sign Ordinance and shall requ 25 review and approval of the Planning Department prior to i 26 stallation of such signs. 27 11) A uniform sign program for this development shall be subm ted to the Planning Department for their review and appro size. 9) All landscaped areas shall be maintained in a healthy and 8811 /// prior to occupancy of any building. Fire Department: 28) Prior to the issuance of building permits, complete buildj plans shall be submitted to the Fire Department for reviei and approval. 29) Additional public and on-site fire hydrants shall be requi at locations to be approved by the Fire Department. 30) Submit two (2) copies of a site plan showing locations of existing and proposed fire hydrants and on-site roads and drives . 31) An all-weather access road shall be maintained throughout construction. 32) All required fire hydrants, water mains and appurtenances shall be operational prior to combustible building materi; being located on the project site. 33) All fire alarm systems, fire hydrants, extinquishing systc automatic sprinklers, and other systems pertinent to the I ject shall be submitted to the Fire Department for approv; prior to construction. //// //// PC RES0 1854 -5- ,.,- %' (. e * I 2 34) Buildings exceeding 10,000 square feet aggregate floor arc 3 openings therein which shall split the building into 10,OC shall be sprinklered or have four-hour fire walls with no 4 square feet (or less) areas.
