HomeMy WebLinkAbout1981-08-26; Planning Commission; Resolution 1857I1 e e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 I 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 1857 - ~~ A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF AN AMENDMENT TO A 104 LOT TENTATIVE TRACT MAP TO CHANGE THE PHASING, INCLUDE A REMAINDER PARCEL AND PREVIOUSLY DESIGNATED SCHOOL SITE ON PROPERTY GENERA LOCATED SOUTH OF ALGA ROAD, EAST OF EL FUERTE ROAD A WEST OF MELROSE AVENUE IN THE P-C AND RD-M(Q) ZONES APPLICANT: DAON CORP./LA COSTA LAND CO. (RANCHEROS/ CREST ) CASE NO: CT 79-25(B) WHEREAS, a verified applicant for certain property, to Portions of Sections 19, 29, 30, 31, Township 12, South Range, 3 west San Bernardino Meridian, County of San Di has been filed with the city of Carlsbad, and referred to the ning Commission; and WHEREAS, said verified application constitutes a reques provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 26th day c August, 1981, hold a duly noticed public hearing as prescribe law to consider said request; and WHEREAS, at said public hearing, upon hearing and consj all testimony and arguments, if any, of all persons desiring heard, said Commission considered all factors relating to the tative Tract Map and Condominium Permit. WOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning C sion as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the public heal the Commission recommends APPROVAL of CT 79-25(B), basc the following findings and subject to the following cor t ions : Findings 1) That the findings made as part of approval of CT 79-25 (Planning Commission Resolution No. 1602) and CT 79-25(i (City Council Resolution No. 6413) are still valid and I1 , . .," b e 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 ! 2o I 21 I 22 23 24 25 26 27 28 I applicable to this application and are incorporated here reference. 2) That the proposed amendnent is consistent with the Gener< Plan, Subdivision Ordinance and Zoning Ordinance. 3) That the project will not create any significant environl impacts, and the Planning Director has determined that t: project has met all requirments of the Carlsbad Environml Ordinance and has issued a Notice of Prior Environmental pliance on July 29, 1981, based on the certification of ronmental Impact Report 307 prepared for the La Costa Ma Plan. 4) The project is consistent with all city public facility ies and ordinances since: a) The applicant has received adequate sewer from the S Marcos County Water District. b) The Planning Commission has, by inclusion of an appr ate condition to this tentative subdivision map, ins that the final map will not be approved unless the C Council finds that sewer service is available to ser project. Development shall occur substa ally as shown unless otherwise noted in these conditions. 2) All previous conditions of approval of CT 79-25(A) (City til Resolution No. 6413) are no longer applicable and sh superceeded by the conditions of approval contained here ~ 3) This subdivision is approved upon the express condition a the final map shall not be approved unless the City Coun finds as of the time of such approval that sewer service 9 available to serve the subdivision. 10 11 12 13 14 15 16 4) This subdivision is approved upon the express condition building permits will not be issued for development of t subject property unless the City Engineer determines tha sewer facilities are available at the time of applicatio such permits and will continue to be available until tim occupancy. I 1 17 18 6) 19 I 20 21 22 This approval is expressly conditioned on the payment by applicant of a public facilities fee as required by City cil Policy No. 17, dated August 20, 1979, on file with t City Clerk and incorporated herein by reference and acco to the agreement executed by the applicant for payment o fee. F,' \ e e 1 2 3 4 5 6 7 8 9 10 11 12 10) A report of a geological investigation and a complete gr plan of the entire site except for building pads or indi lots, shall be contracted by the applicant and shall be mitted to the City Engineer prior to issuance of grading mits. The report shall be prepared by a civil engineer geologist licensed by the State of California and experi in erosion control and slope stability. They shall cert that they have investigated the site and prepared data w full consideration of the consequences to the included a neighboring properties. 11) All cut and fill slopes shall be no steeper than 2 horiz to 1 vertical, unless otherwise approved by the City Eng neer. 12) All exposed slopes shall be hydromulched or otherwise st ilized immediately upon completion of grading activities 13) Clearing operations shall not be allowed in advance of g: ing, but rather only concurrent with grading activities. Clearing shall be limited to the minimum area necessary construct the residences and appurtenant facilities. 13 14) If grading is performed, or if slopes will be exposed du. the rainy season (November 1 through April 15), erosion 1 14 trol measures, such as desiltation basins, sandbags, etc shall be taken and shall be approved by the City Enginee: l5 15) No fill slopes shall extend outside the subdivision boun 16 adjacent to San Marcos Canyon. Street trees shall be provided to enhance the 1 character of the subdivision. Said trees shall be incluc the detailed landscape and irrigation plan and be approvc the Planning Director prior to recordation of final map. The street shall be improve full from El Fuerte Street to just beyond Street "A" for temporary cul-de-sac which shall be constructed to city dards, prior to final occupancy of any units in Phase I Phase 11, whichever occurs first. Full improvements sha extended east to the subdivision boundary prior to final pancy of any units in Phase I11 or Phase IV whichever oc first. 20) Alga Road shall be dedicated and improved along its fron of the subdivision based on a 51 foot half street accord city of Carlsbad standards. Improvements shall include walks, half median, street trees at 40 foot spacing and lights. Additionally, Alga Road shall be extended off- to El Fuerte Street based on the same section. Cut and slopes adjacent to Alga Road shall be 2:l maximum, unles otherwise approved by the City Engineer. These improveml shall be constructed prior to final occupancy of any uni Phase I. 21 1 22) Any remaining public improvements in the El Fuerte half section along the subdivision frontage (sidewalks, stree trees, street lights, graded parkway or others) shall be stalled to conform to city of Carlsbad standards. These provements shall be constructed prior to final occupancy any units in Phase I. The design of all private streets and drainage shall be i proved by the City Engineer. These final maps may record withc meeting conditions 1 - 26 contained herein; however, conc tions No. 28 and 29 shall be complied with prior to fina approval of these two phases. 28) A final map for Phase V may be filed at any time, providl however, that no development shall occur until the final domunium permit for CP-176 has been approved.
