HomeMy WebLinkAbout1981-09-09; Planning Commission; Resolution 1863&+.# e e 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 1863 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A PLANNING COMMISSION DETERMINATION TO RELOCATE AN OFFICE BUILDING FROM ITS PRESENT LOCATION ON ELM AVENUE TO PROPERTY GENERALLY LOCATED ON THE WEST SIDE OF HARDING STREET BETWEEN ELM AVENUE AND OAK AVENUE. APPLICANT : THOMAS NOONAN CASE NO: PCD-33 WHEREAS, a verified application for certain property, to Lots 13 and 14 in Block 57 of Carlsbad subdivision accord to Map 535 filed May 21, 1888. has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 9th day of September, 1981, hold a hearing as prescribed by law to consi said request; and WHEREAS, at said hearing, upon hearing and considering a1 testimony and arguments, if any, of all persons desiring to b heard, said Commission considered all factors relating to the Planning Commission Determination; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: (A) That the foregoing recitations are true and correct. (B) That based on the evidence presented at the hearing, the Commission APPROVES PCD-33, based on the following findin and subject to the following conditions: Findings 1) That the proposed building relocation and use would be consistent with all applicable zoning and building requirements, as discussed in the staff report. //// 4% * 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 / /I /' 2) That the proposed building relocation and use would be compatible with surrounding land uses, as discussed in the staff report. 3) That the Planning Director has determined that this projec is categorically exempt from environmental review per Sect 19.04,070(12) of the Carlsbad Municipal Code. Cond it ions 1) Approval is granted for PCD-33, as shown on Exhibit A, dat August 21, 1981, incorporated by reference and on file in the Planning Department. Development shall occur substan- tially as shown unless otherwise noted in these conditions 2) The applicant shall comply with all conditions of the Building Department, including the relocation correction list. 3) Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applica able city ordinances in effect at time of building permit issuance, 4) Prior to occupation of the relocated office the applicant shall construct and stripe an asphalt parking area as show on Exhibit "A". 5) The applicant shall install a sidewalk to allow pedestrian access from Harding Street to the office building prior to occupancy of the building, PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held ( the 9th day of September, 1981, by the following vote, to wit: AYES : Chairman Marcus, Farrow. Schlehuber and Jose- NOES : Commissioner L'Heureux. ABSENT: Commissioners Friestedt and Rombotis.
