AVENUE EXTENDED, BETWEEN CORINTIA STREET EXTENDED ANI ALGA ROAD EXTENDED. APPLICANT: WOODWARD COMPANIES (HIDDEN MEADOWS) CASE NO: CT 80-9(a) WHEREAS, a verified application for certain property, to 1 Those portions of the Northeast Quarter of Section 3( and the Southeast Quarter of Section 19, Township 12 South, Range 3 West, San Bernardino Meridian, county San Diego, State of California. has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request E provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 9th day of September, 1981, hold a duly noticed public hearing as prescrj by law, to consider said request; and WHEREAS, at said public hearing, upon hearing and consider all testimony and arguments, if any, of all persons desiring t heard, said Commission considered all factors relating to the Tentative Tract Map and Condominium Permit; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: (A) That the foregoing recitations are true and correct. (B) That based on the evidence presented at the public hearing the Commission recommends APPROVAL, of CT 80-9(A), based c the following findings and subject to the following conditions: 28 //// /I <I 0 a I, 1 Findings: II 2 3 4 5 1) The proposed amendment to the tentative map (CT 80-9) is consistent with the Land Use Element of the General Plan because the proposed density does not exceed the allowable density range of 10-20 dwelling units per acre. Further, topographical constraints of the site justify the project' density of 7.17 dwelling units per acre which is lower tha the density range established by the General Plan. Performance of that contract and payment c the fee will enable this body to find that public fa( lities will be available concurrent with need as required by the General Plan. General Conditions: 1) Approval is granted for CT 80-9(A), as shown on Exhibit "I dated August 25, 1981, incorporated by reference and on f: in the Planning Department. Development shall occur sub- stantially as shown unless otherwise noted in these condi- tions. 2) This subdivision is approved upon the express condition 1 the final map shall not be approved unless the City Counc finds as of the time of such approval that sewer service available to serve the subdivision. In the event that sewer is not available, the final map will not be approvt 3) This subdivision is approved upon the express condition 1 building permits will not be issued for development of tl subject property unless the City Engineer determines thal such sewer facilities are available at the time of applic tion for such permits and will continue to be available 1 til time of occupancy. A copy of that agreement, dated March 1980 and July 8, 1981 is on file with the City Clerk and incorporated herein by reference. IO) The applicant shall provide school fees to mitigate condi tions of overcrowding as part of building permit applicat per the existing fee schedule at that time. 11) All conditions contained herein shall supersede all condi tions of CT 80-9, Resolution No. 1644. 15 16 Eng ineer ing Conditions : 12) A report of a geotechnical investigation and a grading pl of the site shall be submitted by the applicant to the Ci permit. The report shall be prepared by a civil engineer experienced in erosion control and slope stability. 17 18 Engineer for approval prior to the issuance of a grading and a geologist licensed by the State of California and 19 1 13) The grading shall be done under the supervision of the ci7 20 21 observed to be different than expected, they shall recommc engineer and geologist. No 27 slopes are permitted within public street right-of-way. 28 PC RES0 NO. 1864 -4- IS ' I* e a 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 I 20 21 22 23 24 25 26 27 28 i 15) To mitigate erosion, all exposed slopes shall be hydro- seeded, seeded or planted immediately upon completion of grading activities, The seed mix shall be designed by an expert in the field based on a soil analysis of the slope: per approval of the Parks and Recreation Director. 16) No grading may be performed during the period of October 1 to April 15, unless an erosion control plan including de- silting basins, etc., is submitted as part of the grading plan and is approved by the City Engineer. 17) Clearing operations shall not be allowed in advance of grz ing, but rather shall be concurrent with and immediately proceeding grading activities. A grading permit must be obtained prior to commencement of clearing operations. Clearing shall be limited to the minimum area necessary t< perform grading operations. 18) No grading shall occur outside the limits of the subdivis: unless a letter of permission is obtained from the owners the affected properties. 19) The design of all private streets and drainage shall be a] proved by the City Engineer. The design shall include street lights, curb and gutter, storm drain facilities or other features as required by the City Engineer. The strl tural section of all private streets shall conform to the City of Carlsbad standards based on R value tests. 20) All private streets and drainage systems shall be maintail by the homeowner's association in perpetuity. This condi- tion excludes all drainage easements granted to the City ( Carlsbad. This condition shall be placed in the CCbR's. 21) Additional drainage easements and drainage structures sha: be provided or installed as may be required by the County Department of Sanitation and Flood Control or the City En( neer. 22) All concrete terrace drains shall be maintained by the hol ~ owner's association if on commonly owned property or the ~ individual property owner if on an individually owned lot perpetuity. '; -' // e e 1 24) The final maps for the phases shown on the tentative map must be recorded in the following order: 2 Phase 2 or 3 Concurrent with or subsequent to Phase 1. 3 Phase 1 First 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 I 20 21 22 23 24 25) Dedication and improvements shall be according to the fol lowing schedule: Phase 1: a. The south half of Alga Road from existing Alga F to Melrose Avenue. Corintia Street. Fe Road based on a section approved by the City Engineer . d. Corintia Street from Melrose Avenue to Street A (The Meadows Drive) -as shown on the tentative ma e. Full improvement of all streets within each phas f. Looping of water line in Street D subject to the approval of the City Engineer and the Fire Chief g. A temporary, paved access road, 20-28 feet wide connecting Street C with Melrose Avenue or Alga Road subject to the approval of the City Enginee and the Fire Chief. b. The full width of Melrose Avenue from Alga Road c. Melrose Avenue from Corintia Street to Rancho Sa Phase 2: a. Construct A Street (the Meadows Drive) from Phas' 1 to Alga Road subject to the approval of the Ci. Engineer . b. Corintia Street based on the typical section shos on the tentative map. c. The temporary intersection of Melrose Avenue and Rancho Santa Fe Road shall be designed and constructed subject to the approval of the City Engineer. If, in the opinion of the City Engine there are operational problems presenting a traf hazard at the temporary intersection, minor revisions to that intersection (eg.: additional paving, medians, curbs, stripping, etc.) may be required within existing R/W prior to final acceptance of Phase 2 or 3. Phase 3: a. Deletion of the temporary access road. b. Full improvement of all streets within the phase c. All disturbed slopes shall be immediately hydroseeded or otherwise stablized for er sion control immediately upon completion of grading activities. b) The timing of all grading activities shall be restric as required by the City Engineer on the grading permi c) Drainage facilities shall be constructed concurrent w grading activities. d) In order to mitigate potentially significant traffic impacts, the intersection of Corintia Street and Melr Avenue shall be designed and constructed, as required the City Engineer, in order to accommodate projected vehicular trips at this intersection. e) Energy conservation measures as stipulated in EIR-307 shall be included in this project. WATER RECLAMATION CONDITIONS 29) The applicant shall agree to utilize reclaimed water, in Type I form, on the subject property in an amount that equals or exceeds the amount of sewage generated by the p ject, or otherwise approved by the City Engineer. 30) The reclaimed water irrigation system shall be maintained and operated by the San Marcos County Water District cons tent with the requirements of the City of Carlsbad. The homeowner's association shall enter into an agreement acceptable to the City Engineer that will give the distri total assurance that they would always have the ability t discharge the effluent. 31) Construction of the reclaimed water system shall comply w Title 17 of the California State Administration Code by r quiring a water master on the job to monitor pipe connec- tions. Said plan shal be approved by the Parks and Recreation Department, prior the issuance of any building permits. Said improvements shall be installed prior to occupancy of any units.
