APPLICANT: WOODWARD COMPANIES (HIDDEN MEADOWS) CASE NO: PUD-20 (A) WHEREAS, a verified application for certain property, to \ Those portions of the Northeast Quarter of Section 3( and the Southeast Quarter of Section 19, Township 12 South , Range 3 West, San Bernardina Meridian, Count! of San Diego, State of California. has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request i provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 9th day of September, 1981, hold a duly noticed public hearing as prescrj by law, to consider said request; and WHEREAS, at said public hearing, upon hearing and considel all testimony and arguments, if any, of all persons desiring 1 be heard, said Commission considered all factors relating to 1 Plannned Unit Development; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: (A) That the foregoing recitations are true and correct. (B) That based on the evidence presented at the public hearinc the Commission approves PUD-20(A), based on the following findings and subject to the following conditions: //// //// 28 //// >I,; e e 1 Findings: ll 2 3 4 5 6 7 8 9 10 11 12 13 14 15 1) The proposed use at the particular location is necessary ar desirable to provide a service or facility which will contl bute to the general well-being of the neighborhood and the community. 2) Such use will not be detrimental to the health, safety or general welfare of persons residing or working in the vicil ty or injurious to property or improvements in the vicinit; 3) All design criteria set forth in Section 21.45.110 and all minimum development standards set forth in Section 21.45.1: of the Zoning Ordinance will be met. 4) The granting of this permit will not adversely affect and will be consistent with the general plan for the city, app cable specific plans, and the adopted plans of any govern- mental agency. 5) The project will not cause any significant adverse environ mental impacts and the Planning Director has issued a Cond tional Negative Declaration (Log No. 688, dated 4/25/80), a Notice of Environmental Compliance, dated August 24, 198 which was approved by the Planning Commission on September 9, 1981. 6) The project is consistent with all City Public Facility Po cies and Ordinances since: I i 16 a. Assurances have been given that adequate sewer for th District. 17 project will be provided by the San Marcos County Wat 18 19 20 21 22 23 24 25 26 27 28 b. The Planning Commission has, by inclusion of an appro priate condition to this project, insured that the fi map will not be approved unless the City Council find that sewer service is available to serve the project. In addition, the Planning Commission has added a cond tion that a note shall be placed on the final map tha building permits may not be issued for this project u less the City Engineer determines that sewer service available. Since the final map cannot be approved an building permits cannot be issued unless sewer servic remains available, the Planning Commission is satisfi that the requirements of the Public Facilities Elemen of the General Plan have been met insofar as they apF to sewer service for this project. Cond it ions : General 1) Approval is granted for PUD-20(A), as shown on Exhibit B, dated June 2, 1980, incorporated by reference and on file PC RES0 NO. 1865 -2- \,: ll a e 1 2 3 4 5 6 7 8 9 10 11 2) 3) the Planning Department. Development shall occur substan- tially as shown unless otherwise noted in these conditions This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application : such sewer permits and will continue to be available until time of occupancy. This note shall be placed on the final map. This project is approved upon the express condition that tl applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated August 29, 1979, on file with the City Clerk and incorporated herein by reference, according to the agreement executed by the applicant for p ment of said fee. A copy of that agreement dated 3/11/80 i 7/8/81, is on file with the City Clerk and incorporated he] in by reference. If said fee is not paid as promised, thir application will not be consistent with the General Plan a1 approval for this project shall be void. 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 4) Approval of this request shall not excuse compliance with i sections of the Zoning Ordinance and all other applicable city ordinances in effect at time of building permit issu- ance . Planning Department Conditions 5) Prior to the issuance of building permits, the applicant shall submit a final Planned Unit Development Plan, incorp( rating all changes required herein, for the approval of thc Planning Director. 6) The applicant shall establish a homeowner's association ant corresponding covenants, conditions and restrictions. Sail CC&R's shall be submitted to and approved by the Planning Department prior to final map approval. 7) A detailed landscape and irrigation plan for the entire sii must be approved by the Planning Director prior to issuanct of building permits excluding model homes. 8) Prior to approval of the final map, for Phase I, the appli- cant shall submit plans for the proposed Community Identit; Signs subject to the approval of the Planning Director. 9) All conditions of CT 80-9(A) are incorporated herein by re erence and shall he strictly complied with as part of this approval , 10) The conditions contained herein shall supersede all condi- tions of PUD-20 (Reso, 1646)- 28 PC RES0 NO. 1865 -3- '1,; 0 e I. 2 11) The standards of the RDM zone regarding permitted uses, COI ditional uses, building height, placement of buildings and 3 yard requirements shall apply to the subject property unle: 'otherwise stated herein or shown otherwise on all approved 12) All buildings backing or siding onto Melrose Avenue shall 4 exhibits. 6 5 maintain a building setback of 35' from curb line. One half of the Recreational Vehicle storage lot shall be improved prior to the issuance of a final occupancy permit for the 200th unit in the subdivision. The remainder of t 14 15 16 17 R.V. storage lot shall be improved prior to the issuance o final occupancy permit for the last unit in the subdivisio This condition may be superseded by an R.V. storage maste plan agreement between the City of Carlsbad and the La Cos Land Co./Daon Corporation if such an agreement is in effec at the time this condition must be satisfied. ENVIRONMENTAL CONDITIONS : l8 I 16) The following conditions of the Negative Declaration issue I shall be complied with: I' for the previously approved plan (EIA No. 688, dated 4/25/ I 20 21 22 a) Clearing operations shall occur only immediately prio to grading activities. All disturbed slopes shall be immediately hydroseeded or otherwise stablized for er sion control immediately upon completion of grading activities. 23 24 b) The timing of all grading activities shall be restric as required by the City Engineer on the grading permi c) Drainage facilities shall be constructed concurrent w 25 I grading activities. 26 27 28 d) In order to mitigate potentially significant traffic impacts, the intersection of Corintia Street and Melr Avenue shall be designed and constructed, as required the City Engineer, in order to accommodate projected vehicular trips at this intersection. WATER RECLAMATION CONDITIONS: 17) The applicant shall agree to utilize reclaimed water, in TI I form, on the subject property in an amount that equals 01 exceeds the amount of sewage generated by the project, or 2 otherwise approved by the City Engineer. 18) The applicant shall prepare, to the satisfaction of the Pal and Recreation Director and the City Engineer, a document outlining proposed methods of type 1 reclaimed water use. This document shall contain a plant list of salt and drou! tolerant vegetation, water absorption rates per plant and soils, the gallons of water per acre needed to accommodate the proposal and a soil-flushing program. The document shi also include criteria for operating, maintaining and monitoring the irrigation area and system. This shall be done prior to approval of the final map for Phase I. 19) The reclaimed water irrigation system shall be maintained ( operated by the San Marcos County Water District consisten, with the requirements of the City of Carlsbad. The home- owner's association shall enter into an agreement acceptab. to the City Engineer that is to give the district total assurance that they would always have the ability to dis- charge the effluent. 20) Construction of the reclaimed water system shall comply wi Title 17 of the California State Administration Code by requiring a water master on the job to monitor pipe connec. tions. Low trajectory sprinklers shall be utilized and thl irrigation rate shall be regulated so that there will be nl runoff . Fire Department Conditions 21) All driveways and emergency vehicle easements shall be im- proved to minimum standards as required by the Fire Chief City Engineer. 22) In order to provide for fire protection during the constru tion period, the applicant shall maintain passable vehicul access to all buildings.
