I, r e e 1 ll PLANNING COMMISSION RESOLUTION NO. 1880 2 3 4 5 6 7 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSEAD, CALIFORNIA, RECOMMENDING APPROVAL FOR MINIUM PERMIT ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF THE INTERSECTION OF CAMINO VIDA ROBLE MID LAS PALMAS DRIVE APPLICANT: CARLSBAD INDUSTRIAL ASSOCIATES, LTD. CASE NO: CT-81-38/CP-184 A 22 UNIT INDUSTRIAL TENTATIVE TRACT MAP AND CONDO- I WHEREAS, a verified application for certain property, to 1 wit: a 9 thereof No. 8054 filed. December 31, 1974. '> v I/ a a 1 2 3 4 5 6 7 8 9 10; 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 2) The site is physically suitable in size and shape for the proposed development since sufficient public improvements adequate amenities necessary to serve the lot are provided without the need for excessive modification to the site. 3) The project is consistent with all city public facility PO icies and ordinances since: a) All necessary public improvements have been provided c will be available concurrent with need as required by conditions of approval. b) The applicant has agreed and is required by the inclus of an appropriate condition to pay a public facilities fee. Performance of that contract and payment of the will enable this body to find that public facilities B be available concurrent with need as required by the General Plan. 4) The proposed project is compatible with the surrounding 1~ uses since surrounding properties have been developed wit? industrial uses or designated for industrial development. 5) The Planning Director has determined that this project is categorically exempt from environmental review according t Section 19.04.070 (1) (H) of the Carlsbad Environmental Or nance. 1 6) The applicant has given and will give additional notice as specified in the Subdivision Map Act and the Carlsbad Municipal Code of the proposed conversion and right to purchase to the tenants of the project. 7) The project meets all development standards and design crj teria of the condominium ordinance and underlying P-M zonc relative to a non-residential condominium project. Conditions General Conditions: 1) Approval is granted for CT 81-38/CP-184, as shown on Exhibit (s) "A"-"H'', dated September 17, 1981, incorporate( reference and on file in the Planning Department. Develo] ment shall occur substantially as shown unless otherwise noted in these conditions. 2) This project is approved upon the express condition that 1 final map shall not be approved unless the City Council f: as of the time of such approval that sewer service is ava: able to serve the subdivision. 27 /I /// 28 /1 /// )I PC RES0 1880 -2- .. 1 0 0 1 2 3 4 5 6 3) This project is approved upon the express condition that t applicant shall pay a public facilities fee as required bl City Council Policy No. 17, dated August 29, 1979, on fil with the City Clerk and incorporated herein by reference, according to the agreement executed by the applicant for 1 ment of said fee a copy of that agreement dated August 19, 1981, is on file with the City Clerk and incorporated herc by reference. If said fee is not paid as promised, this z plication will not be consistent with the General Plan and approval for this project shall be void. 4) The applicant has given and shall give additional notice c 7 the conversion to all tenants as required by the Subdivisi Map Act and the Carlsbad Municipal Code. 8 5) Approval of this request shall not excuse compliance with 9 sections of the Zoning Ordinance and all other applicable city ordinances in effect at time of building permit issu- 10 ance . 11 Planning Department: 12 13 14 15 16 6) The applicant shall prepare a reproducible mylar of the fi site plan incorporating the conditions contained herein. Said site plan shall be submitted to and approved by the Planning Director prior to approval of the final map. 7) The applicant shall establish an owner's association and c responding covenants, conditions and restrictions. Said CC&R's shall be submitted to and approved by the Planning Department prior to final map approval. 17 8) The applicant shall prepare a detailed landscape and irrig improvements shown on this plan shall be completed prior t Planning Director prior to final map approval.
