A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING AN AMEND-
MENT TO A CONDITIONAL USE PERMIT TO OPERATE A
RECYCLING CENTER ON PROPERTY GENERALLY LOCATED
ON THE WEST SIDE OF THE PALOMAR TRANSFER STATION
IN THE M-Q ZONE

WHEREAS, a verified application has been filed with the Ci
8 of Carlsbad and referred to the Planning Commission; and
9 WHEREAS, said verified application constitutes a request a

WHEREAS, at said hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be
heard, said Commission considered all factors relating to CUP-
140(A).
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Comn
sion of the City of Carlsbad as follows:
(A) That the foregoing recitations are true and correct.
(B) That based on the evidence presented at the public hearins
the Commission APPROVES CUP-l40(A), based on the followins
findings and subject to the following conditions:

the various elements and objectives of the General Plan, a is not detrimental to existing uses or to uses specificall
permitted in this zone for the reasons stated in the staff report.
2) The subject property is adequate in size and shape to accc modate the proposed use for the reasons stated in the staf
report.
3) All of the yards, setbacks, walls, fences, landscaping and
other features necessary to adjust the requested use to ex isting and permitted future uses in the neighborhood will provided and maintained for the reasons stated in the staf report.
4) The street system serving the subject property is adequate properly handle all traffic generated by the proposed use
the reasons stated in the staff report.
5) The project will not cause any significant environmental i
pacts and a Negative Declaration has been issued by the PI
ning Director on August 10, 1981 and approved by the Planr
Commission on November 18, 1981.
Conditions-of -.Approval
General :
1) Approval is granted for CUP-l40(A), as shown on Exhibit "I
dated August 26, 1981, incorporated by reference and on fj in the Planning Department. Development shall occur sub-
stantially as shown unless otherwise noted in these condi-
tions .
2) Approval of this request shall not excuse compliance with
sections of the Zoning Ordinance and all other applicable city ordinances in effect at time of building permit issu-
ance .
Planning-Department: -
3) All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris.
4) Any signs proposed for this development shall be designed conformance with the city's Sign Ordinance and shall requj review and approval of the Planning Department prior to ir stallation of such signs.
5) This approval shall become null and void unless the use i: commenced not later than one year after the start of construction and diligently pursued thereafter.

6) The site shall be completely enclosed by a six foot high, redwood slated chain link fence with gates and dense landscaping to provide a visual screen, pursuant to city
standards and subject to the approval of the Planning Dire tor and Parks and Recreation Director. The gates shall be locked when the center is not in operation.
7) Prior to the issuance of a building permit or grading perm whichever occurs first, all conditions of CUP-l4O(A) shall complied with in their entirety unless otherwise stated
herein.
8) Prior to the opening of the recycling center, the undergrc storage tanks shall be inspected by the Building and Fire Departments for compliance with all applicable City and St Fire and Building Codes. Opening of the recycling center
shall not be permitted prior to compliance with applicable
sections of the Fire and Building Codes.
9) The applicant shall prepare a detailed landscape and irrig tion plan which shall be submitted to and approved by the Planning Director prior to the issuance of building permit
10) This conditional use permit shall expire and all uses pur-
suant to it shall cease seven years after the date of issu ance. This permit may be extended for a reasonable period time not to exceed seven years upon written application of
the permittee filed with the Planning Commission not later than 90 days prior to the date of termination. In grantin such extension, the Planning Commission shall find that no substantial adverse affect on surrounding land uses is fou

The report shall include a list of complaints made concern
the use. This permit may be revoked at any time after a p
lic hearing if it is found that the use ha5 a significant
detrimental effect on surrounding land uses or the conditi imposed herein have not been met.
11) All parking lot trees shall be a minimum of 15 gallons in size.
12) Trash receptacle areas shall be enclosed by a 6 foot high masonry wall with gates pursuant to city standards. Locat of said receptacles shall be approved by the Planning Dire tor.
13) All roof appurtenances, including air conditioners, shall
architecturally integrated and shielded from view and the sound buffered from adjacent properties and streets to the satisfaction of the Planning Department and Building Direc tor. 11 PC RES0 #I851 -3-

14) The applicant shall complete all the conditions of the ori ginal CUP except that the previous condition No. 10 shall modified to read as follows:

"The applicant shall improve El Camino Real and Palomar
Airport Road on the basis of a center line to curb face
width of 53 feet. The El Camino Real improvements shal include a full width median island complete with left t
pocket, median landscaping and irrigation in conformanc
with city of Carlsbad Standards. The applicant shall further reconstruct the existing paved median area witk
the proposed median break and left turn pocket areas tc
bring the structural section into conformance with the city of Carlsbad Standards.

Prior to the issuance of building permits for the site, applicant shall enter into an agreement with the city
whereby the applicant will agree to design and construc
the above referenced improvements within a one year per prior to issuance of building permits for the site.

The City Engineer may delay the requirement for the
median island, landscaping and irrigation if, in his
opinion, the construction would be premature and a
hazard. In this event, the median island shall be constructed at such later time as the City Engineer ma)

Fire-Department:
15) Storage of oil shall conform to the requirements of the Ur form Fire Code. A permit must be received prior to the 01 ing of the recycling center.
