CASE NO: MP-l39(A) APPLICANT:. -THE-PLANNING-CENTER.. - - .. WHEREAS, a verified application for certain property, to wit: Fractional Section 23, Fractional Section 24, Section 25, portions of Section 26 and 35, Section 36 and a portion of Lot A of Rancho Aqua Hedionda, Map No. 823 file in the Office of the County Recorder of San Diegc County, State of California, all in Township 12 South has been filed with the city of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application constitutes a requc as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission on the 9th day of December, 1981, did hold duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all person: desiring to be heard, said Commission considered all factors relating to MP-l39(A). NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the city of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commission recommends APPROVAL of MP-l39(A), based on t following findings and subject to the following conditions: I //// 28 //// .d 4 ā€˜\Lā€ b - II m 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Findings: 1) The proposed development as described by the Master Plan consistent with the provisions of the General Plan and an applicable specific plans. 2) Although all necessary public facilities may not be avail able at this time, their availability, concurrent with th need, has been assured through the provisions of the Mast Plan and adequate provisions have been provided to implem those portions of the Capital Improvement Program applica to the subject property. 3) The residential and open space portions of the community will constitute an environment of sustained desirability 4 stability; and it will be in harmony with or provide compl ible variety to the character of the surrounding area; anc the sites proposed for public facilities, such as schools playgrounds and parks, are adequate to serve the anticipa. population and appear acceptable to the public authoritie: having jurisddiction thereof. 4) The proposed commercial uses will be appropriate in area, location and overall design to the purposes intended; and the design and development standards are such as to create an environment of sustained desirability and stability; ar such development will meet performance standards establisk by Title 21 of the Carlsbad Municipal Code. In the case of institutional, recreational, and other simi lar nonresidential uses, such development will be approp- riate in and surrounding areas are protected from any sig- nificant adverse effects from such development. 5) The streets and thoroughfares proposed are suitable and ad quate to carry the anticipated traffic thereon. 6) The proposed commercial developments can be justified econ omically at the locations proposed and will provide adequa commercial facilities of the types needed at such location proposed. 7) The area surrounding this development is or can be planned and zoned in coordination and substantial compatibility wi said development. 8) Appropriate measures are proposed to mitigate any signif- icant adverse environmental impact as noted in the adopted Environmental Impact Report for this project. //// //// //// PC RES0 NO. 1897 -2- .a i e k. ?* c II a 0 1 Conditions: 2 3 1) Section V G "Public Facilities Funding" of the Master Pla. text shall be revised to incorporate the following con- dition: 4 5 6 7 Each applicant shall be jointly and severely responsible j the installation of public facilities required by this Master Plan. The applicant may snake any private arrange- ments for distributing this responsibility among themselvt however, such private arrangements shall not relieve the individual aapplicants of their responsibility insofar as the city is concerned. 8 Planning Commission of the city of Carlsbad, California, held c g PASSED, APPROVED AND ADOPTED at a regular meeting of the 10 the 9th day of December, 1981, by the following vote, to wit: 11 12 AYES: Chairman Marcus, Commissioners Rombotis, Farrow, NOES : None.
