Per mance of that contract and payment of the fee will enable body to find that public facilities will be available conc rent with need as required by the General Plan. 4) The Planning Director has determined that this zone change not have a significant impact on the environment and there has issued a Conditional Negative Declaration on December 1981 which was approved by the Planning Commission on Decei 23, 1981. 5) Prior to development of this property, a site development : must be approved by the Planning Commission. At that time applicant will be required to comply with all mitigation ml sures of the Conditional Negative Declaration. 6) The proposed change of zone is consistent with all other e ments of the General Plan. Cond it ions 1) This project is approved upon the express condition that tl applicant shall pay a public facilities fee as required by Council Policy No. 17, dated August 29, 1979, on file wit1 City Clerk and incorporated herein by reference, and accorc to the agreement executed by the applicant for payment of I fee a copy of that agreement dated May 29, 1981, is on filt with the City Clerk and incorporated herein by reference. said fee is not paid as promised, this application will no1 consistent with the General Plan and approval for this pro: shall be void. 2) Prior to development of this property, a Site Development I must be approved by the Planning Commission. 3) During construction, the following measures shall be obsery to protect adjacent archeological sites: a. Prior to any construction activity the boundaries of tk property shall be clearly marked. b. Any construction equipment, materials, and vehicles shc be staged in areas devoid of cultural resources. c. Adjacent parcels of land shall be restricted from use E borrow pits for construction activity. d. Construction personnel shall be restricted from random grading or surf ace collect ions.
