A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING A TENTATIVE
SUBDIVISION MAP AND PLANNED UNIT DEVELOPMENT TO
DEVELOP 24 INDUSTRIAL LOTS ON PROPERTY GENERALLY
LOCATED ON THE EAST SIDE OF EL CAMINO REAL NORTH OF
PALMER WAY
APPLICANT: INTERAMERICAN DEVELOPMENT COMPANY
CASE NO: CT-81-45/PUD-34
WHEREAS, a verified application for certain property, to w
Parcel 1, as shown on parcel map filed at page 11573 of pa
maps in the office of the County Recorder, August 10, 1981
has been filed with the City of Carlsbad, and referred to the
Planning Commission; and
WHEREAS, said verified application constitutes a request a
provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 23rd day of
December, 1981, hold a duly noticed public hearing as prescribc
law, to consider said reuuest; and
WHEREAS, at said public hearing, upon hearing and consider
all testimony and arguments, if any, of all persons desiring tc
heard, said Commission considered all factors relating to the 1
tative Tract Map and Planned Unit Development; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Comm:
sion as follows:
(A) That the foregoing recitations are true and correct.
(B) That based on the evidence presented at the public hearing, Commission APPROVES CT 81-45/PUD-34, based on the followin5
findings and subject to the following conditions:

4) The proposed project is compatible with the surrounding ft land uses since surrounding properties are designated for dustrial development on the General Plan and other resider developments are topographically separated from the projec site.
5) The Environmental effects of this project have already bee considered in conjunction with another project and previoc certified environmental documents and a Notice of Prior Er ronmental Compliance has been issued by the Planning Direc
on November 12, 1981 and approved by the Planning Commissj
on December 23, 1981.

General Conditions
1) Approval is granted for CT 81-45/PUD-34, as shown on Exhib dated November 6, 1981, and Exhibits B, C, and D dated Nov
25, 1981 incorporated by reference and on file in the Plan Department. Development shall occur substantially as show
unless otherwise noted in these conditions.
2) This project is approved upon the express condition that t'
final map shall not be approved unless the City Council fi as of the time of such approval that sewer service is
available to serve the subdivision.
3) This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application such sewer permits and will continue to be available until time of occupancy. This note shall be placed on the final

17) According to City Council Policy No. 30, the project shall attempt to develop a ride to work and home program for its employees with the North County Transit District. Furthermore, the project shall attempt to limit the stagge of worker shifts so as to facilitate the success of said
program.
18) All conditions of Site Development Plan, SDP-78-1(B), appr by the Planning Commission, are incorporated herein by reference and shall be complied with in their entirety.

The grading for this project is defined as "controlled
grading" by Section 11,06,17O(a) of the Carlsbad Municipal
Code. Grading shall be performed under the observation ol civil engineer whose responsibility it shall be to coordin

with the approved grading plan, submit required reports to City Engineer and verify compliance with Chapter 11.06 of Carlsbad Municipal Code.

27) No Grading shall occur outside the limits of the subdivisi unless a letter of permission is obtained from the owners

accordance with approved grading plan, under permit PE 2.81.48. All slopes shall be stabalized, irrigated and
landscaped prior to occupancy of any unit in this development.
