HomeMy WebLinkAbout1981-12-23; Planning Commission; Resolution 1903t ll e 0 1 2 3 4 5 6 7 8 9 3.0 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 PLANNING COMMISSION RESOLUTION N0.1903 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A TENTATIVE SUBDIVISION MAP AND PLANNED UNIT DEVELOPMENT TO DEVELOP 24 INDUSTRIAL LOTS ON PROPERTY GENERALLY LOCATED ON THE EAST SIDE OF EL CAMINO REAL NORTH OF PALMER WAY APPLICANT: INTERAMERICAN DEVELOPMENT COMPANY CASE NO: CT-81-45/PUD-34 WHEREAS, a verified application for certain property, to w Parcel 1, as shown on parcel map filed at page 11573 of pa maps in the office of the County Recorder, August 10, 1981 has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request a provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 23rd day of December, 1981, hold a duly noticed public hearing as prescribc law, to consider said reuuest; and WHEREAS, at said public hearing, upon hearing and consider all testimony and arguments, if any, of all persons desiring tc heard, said Commission considered all factors relating to the 1 tative Tract Map and Planned Unit Development; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Comm: sion as follows: (A) That the foregoing recitations are true and correct. (B) That based on the evidence presented at the public hearing, Commission APPROVES CT 81-45/PUD-34, based on the followin5 findings and subject to the following conditions: Findinss a 1) The project is consistent with the city's General Plan sinc the property is designated by the Land Use Element of the General Plan for Planned Industrial use. 28 //// 0 0 1 2) The site is physically suitable for the type and density c development since the site is adequate in size and shape t 2 accommodate development as proposed. 3 4 5 6 7 8 9 10: 11 12 13 14 15 16 3) The project is consistent with all city public facility PO icies and ordinances since: a) The Planning Commission has, by inclusion of an approF condition to this project, insured that the final map not be approved unless the City Council finds that sew service is available to serve the project. In additic the Planning Commission has added a condition that a shall be placed on the final map that building permits not be issued for the project unless the City Engineer determines that sewer service is available, and buildi cannot occur within the project unless sewer service r mains available, the Planning Commission is satisfied the requirements of the public facilities element of t General Plan have been met insofar as they apply to se service for this project. b) All necessary public improvements have been provided 0' will be required as conditions of approval. c) The applicant has agreed and is required by the inclus of an appropriate condition to pay a public facilities Performance of that contract and payment of the fee wi enable this body to find that public facilities will b( available concurrent with need as required by the Gene, Plan. I 17 d) Assurances have been given that adequate sewer for the ject will be provided by the city of Carlsbad. 18 19 20 21 22 23 24 4) The proposed project is compatible with the surrounding ft land uses since surrounding properties are designated for dustrial development on the General Plan and other resider developments are topographically separated from the projec site. 5) The Environmental effects of this project have already bee considered in conjunction with another project and previoc certified environmental documents and a Notice of Prior Er ronmental Compliance has been issued by the Planning Direc on November 12, 1981 and approved by the Planning Commissj on December 23, 1981. 25 26 6) The project is consistent with the previously approved Sit Development Plan (SDP 78-1(B)). 27 11 Conditions of Approval ///I 28 PC RES0 # 1903 -2- ., 0 * 1 2 3 4 5 6 7 8 9 lo; 11 12 13 14 15 16 17 18 19 I 20 21 22 23 24 25 26 27 28 General Conditions 1) Approval is granted for CT 81-45/PUD-34, as shown on Exhib dated November 6, 1981, and Exhibits B, C, and D dated Nov 25, 1981 incorporated by reference and on file in the Plan Department. Development shall occur substantially as show unless otherwise noted in these conditions. 2) This project is approved upon the express condition that t' final map shall not be approved unless the City Council fi as of the time of such approval that sewer service is available to serve the subdivision. 3) This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application such sewer permits and will continue to be available until time of occupancy. Planning: 6) The applicant shall prepare a reproducible mylar of the fir site plan incorporating the conditions contained herein. 2 site plan shall be submitted to and approved by the Plannir Director prior to the issuance of building permits. 7) The applicant shall establish a owner's association and corresponding covenants, conditions and restrictions. Sai( CC&R's shall be submitted to and approved by the Planning I partment prior to final map approval. 8) The applicant shall prepare a detailed landscape and irrigz plan which shall be submitted to and approved by the Plannj Director prior to the issuance of building permits. 9) All parking lot trees shall be a minimum of 15 gallons in size. Loca, of said receptacles shall be approved by the Planning Director. 14) All roof appurtenances, including air conditioners, shall architecturally integrated and shielded from view and the sound buffered from adjacent properties and streets to thf satisfaction of the Planning Department and Building Dire( tor. 15) The applicant shall submit a street name list consistent c the city's street name policy subject to the Planning Director's approval prior to final map approval, 16) The project shall provide bus stop facilities at locations subject to the satisfaction of the North County Transit Di trict. Said facilities shall at a minimum include a benck free from advertising and a pole for the bus stop sign. 1 bench and pole shall be designed in a manner so as to not detract from the basic architectural theme of the project said design shall be subject to the approval of the Plannj Director and North County Transit District, 17) According to City Council Policy No. 30, the project shall attempt to develop a ride to work and home program for its employees with the North County Transit District. Furthermore, the project shall attempt to limit the stagge of worker shifts so as to facilitate the success of said program. 18) All conditions of Site Development Plan, SDP-78-1(B), appr by the Planning Commission, are incorporated herein by reference and shall be complied with in their entirety. 119) All lighting for the project shall be directed away from adjoining residential areas. 20) Approval of this tentative tract map shall expire eighteen months from the date of City Council approval unless a fin map is recorded, An extension may be requested by the ap- plicant. Grading shall be performed under the observation ol civil engineer whose responsibility it shall be to coordin site inspection and testing to insure compliance of the wo with the approved grading plan, submit required reports to City Engineer and verify compliance with Chapter 11.06 of Carlsbad Municipal Code. 23 24 25 26 27 27) No Grading shall occur outside the limits of the subdivisi unless a letter of permission is obtained from the owners the affected properties. 28) All grading conducted on this site shall be accomplished i accordance with approved grading plan, under permit PE 2.81.48. II e e 1 29) All drainage systems shall be maintained by the owner's association in perpetuity. This responsibility shall be 2 clearly stated in the CC&R's. 3 4 5 6 7 30) No lot in this subdivision except Lot 2 may be further subdivided, This note shall be placed on the final map. 31) The owner's association shall be responsible for the maintenance and operation of all private water mainsp hydrants and other appurtenances.
