HomeMy WebLinkAbout1982-01-27; Planning Commission; Resolution 1915r. .- c // 0, (t 1 PLANNING COMMISSION RESOLUTION NO. 1915 2 3 4 5 6 7 8 to wit: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, DENYING A VARIANCE TO ALLOW TANDEM PARKING ON PROPERTY GENERALLY LOCATED ON THE WEST SIDE OF MARINA DRIVE. APPLICANT: APELIAN CASE NO: V-331 WHEREAS, a verified application for certain property, Lots 69 and 70 of Shelter Cove, of that tract descril in Map 5162 recorded April 23, 1963 9 has been filed with the city of Carlsbad, and referred to the lo 11 Planning Commission; and WHEREAS, said verified application constitutes a 12 request as provided by Title 21 of the Carlsbad Municipal Code I1 13 /and 14 15 of January, 1982, hold a duly noticed public hearing as 16 17 prescribed by law to consider said request; and 18 considering all testimony and arguments, if any, of all persor 19 desiring to be heard, said Commission considered all factors 20 elating to V-331. 21 22 Fommission of the city of Carlsbad as follow: WHEREAS, the Planning Commission did, on the 27th da] WHEREAS, at said public hearing, upon hearing and I NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planninc 23 I1 That the foregoing recitations are true and correct. 24 B. That based on the evidence presented at the public hearin? the Commission DENIES V-331, based on the following 25 findings: 26 Findings: 27 1) There are no exceptional or extraordinary circumstances applicable to the property that do not apply to other 28 properties in the same vicinity and zone since the propert has adequate area to design a project which does not requj tandem parking. -I -b* A I/ 0 a 1 2, 2 3 3) 4 5 6 7 No other properties in the same vicinity and zone share a similar property right which is denied to this property because no other properties having lot widths greater thar 50' have tandem parking. The granting of the requested variance could have a detrimental effect on other property in the vicinity of tk subject property since approval could establish an undesirable precedent for approving similar requests for tandem parking on lots which are equal to or greater than feet in width, and thus, increase the existing traffic problems in the Bristol Cove area. PASSED, APPROVED AND ADOPTED at a regular meeting of 8 9 10 11 12 Planning Commission of the city of Carlsbad, California, held the 27th day of January, 1982, by the following vote, to wit: AYES : Chairman Farrow, Commissioners Marcus, Romb NOES : None .
