HomeMy WebLinkAbout1982-03-10; Planning Commission; Resolution 19282 ll e 0 1 PLANNING COMMISSION RESOLUTION NO. 1928 2 3 4 5 6 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A VARIANCE TO ALLC A FREEWAY-ORIENTED SIGN TO EXCEED THE MAXIMUM HEIGHT LIMIT BY 8 FEET FOR A TOTAL SIGN HEIGHT OF 58 FEET, C PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF ELM AVENUE BETWEEN THE INTERSTATE 5 FREEWAY OFF-RAMP AND HARDING STREET. APPLICANT: SIXPENCE INNS CASE NO: v-334 7 WHEREAS, a verified application for certain property, 8 wit: Portion of Tract 117, Map No. 1661 filed March 15, l! 9 has been filed with the city of Carlsbad, and referred to the 10 11 12 13 14 15 16 17 18 19 Planning Commission; and WHEREAS, said verified application constitutes a reql provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 10th da] March, 1982, hold a duly noticed public hearing as prescribed to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persol desiring to be heard, said Commission considered all factors relating to V-334. 2o I NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannin! 21 omission of the city of Carlsbad as follows: i: 1 ) That the foregoing recitations are true and correct. ) That based on the evidence presented at the public hearinc Commission APPROVES V-334, based on the following finding! subject to the following conditions: 24 25 /]Findings : 26 27 28 1) That there are exceptional or extraordinary circumstances apply to this property and the intended use because the p' is below the grade of the freeway and the proposed sign w identify three freeway-oriented uses. I t e 0 1 2 3 4 5 6 7 8 9 10; 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 2) That this property would be denied a property right sharec other properties in the same vicinity and zone because otl. property has been granted a similar request and all other freeway-oriented uses at this intersection have signs whic clearly visible from the freeway, 3) The three uses identified on the sign are located on propc a joint parking agreement and reciprocal easements for acc and parking, as well as a specific plan for two of the us( All uses together constitute one freeway-service facility 4) That the granting of this variance would not be injurious the public health and welfare since a location will be se: for the sign which will not in any way obstruct visibilit; traffic , which have a common development scheme and are related thl 5) That the granting of this variance will not adversely effc the general plan because the sign would not create any ne( visual impacts on adjacent properties nor create any situ( that are dangerous to the public's health and welfare. Conditions: 1) Approval is granted for V-334 as shown on Exhibits A and I dated January 26, 1982, unless otherwise noted in these conditions. These exhibits are incorporated by reference on file in the Planning Department. 2) The blank sign on the lower portion of the sign structure labeled "Proposed Sign By Others" is not approved and sha deleted from the exhibits. A sign identifying a use for "Parisi Property" to the north shall be permitted pursuan SP-30 if the use is a freeway-service facility developed according to SP-30, the sign is integrated into the sign on exhibits A & B and has been approved by the Planning Director. Otherwise no additional signs shall be allowed the structure approved by this variance. 3) The sign shall have a wood trim and the supporting column shall be covered with matching wood. 4) The Village Redevelopment Area shall not be identified on sign. 5) All other signs on the property shall conform to city ordinances and shall require the approval of the Planning Director. 6) A precise location for the sign shall be determined prior the issuance of a building permit subject to the approval the City Engineer and the Planning Director. The propose alternate location at the immediate corner of Elm and the freeway off-ramp shall be deleted from consideration.
