APPLICANT: CHINQUAPIN INVESTMENTS CASE NO: CT 82-2/CP-202 WHEREAS, a verified application for certain property, to I A portion of tract 238 of Thumlands according to Map 1681, filed in the County of San Diego has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request t provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 24th day of March, 1982, hold a duly noticed public hearing as prescribed law, to consider said request; and WHEREAS, at said public hearing, upon hearing and conside, all testimony and arguments, if any, of all persons desiring heard, said Commission considered all factors relating to the Tentative Tract Map and Condominium Permit. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: (A) That the above recitations are true and correct. (R) That based on the evidence presented at the public hearin Commission APPROVES CT 82-2/CP-202 based on the following findings and subject to the following conditions: Findinss d 1) The project is consistent with the city's General Plan s the proposed density of 19.6 du's/acre is within the den range of 10-20 du's/acre specified for the site as indic on the Land Use Element of the General Plan. Trash receptacle areas shall be enclosed by a 6 foot hig masonry wall with gates pursuant to city standards. LOC of said receptacles shall be approved by the Planning Director. Approval of this tentative tract map shall expire eighte, months from the date of City Council approval unless a f: map is recorded. An extension may be requested by the a] plicant. Said extension shall be approved or denied at i discretion of the City Council. In approving an extensic the City Council may impose new conditions and may revisl existing conditions. The applicant shall provide double-paned windows and structural insulation for the units to achieve an interic noise level at or below 45 DBA, subject to the approval t the Building Director. The applicant shall provide a noise attenuation wall alol the westernmost property line. This restriction shall: a) Apply from the date of issuance of the last occupant: permit of said 3 units for one year; b) Ensure that such units are owner occupied; c) Ensure that said permits are sold only to first time homeowners.
