HomeMy WebLinkAbout1982-04-28; Planning Commission; Resolution 1944e 0 1 2 3 4 5 6 7 8 PLANNING COMMISSION RESOLUTION NO. 1944 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A PRECISE DEVELOPMENT PLAN FOR THE EXPANSION OF THE MEADOWLARK RECLAMATION FACILITY ON PROPERTY GENERALL' LOCATED ON THE WEST SIDE OF RANCHO SANTA FE ROAD IN SAN MARCOS CANYON. APPLICANT: SAN MARCOS COUNTY WATER DISTRICT ~ , CASE NO: PDP-3(A) WHEREAS, a verified application for certain property, to \ A portion of the East one half of Section 30, Township 12 South, Range 3 West, San Bernardino Meridian accord- ing to the U. s. (B) That based on the evidence presented at the public hearinc Commission recommends APPROVAL of PDP-3(A), based on the following findings and subject to the following conditions 25 11 Findings: 26 27 1) The proposed Precise Development Plan ensures compatibilit the development with the General Plan because: 28 /1/'// jJ // 0 e 1 2 3 4 a) The General Plan Land Use Element designates a public utility in this area. b) Subsequent development in the area served by the treatment plant will be consistent with the General E because all zoning in the service area is consistent the General Plan. 5 following reasons: 6 2) The proposed Precise Development Plan will not result in e significant adverse impacts to the environment due to the 7 a 9 10 11 12 13 a) The conditions of approval include mitigation measure outlined in the EIR certified by the San Marcos Count Water District and mitigate potential adverse environmental impacts. b) The project will be subject to further review and approval by effected State and Federal agencies. Prior to signing of the final Precise Development Plan the City Manager shall determine that all applicable requiremc have been incorporated into the plan and that all conditic of approval have been satisfactorily met or otherwise guaranteed. The final signed Precise Development Plan shz be the official site layout plan for the property and shal attached to any application for a building permit for any undertaken, or structures or buildings constructed pursuar this approval. No building permits shall be issued until final Precise Development Plan is approved. Prior to approval of the final Precise Development Plan, t District shall enter into a service agreement with the cit of Carlsbad to permit the District to distribute and dispc of reclaimed water from the treatment plant to property within the incorporated limits of the city of Carlsbad. Prior to approval of the final Precise Development Plan, t district shall enter into an agreement with the city guaranteeing that the district will make available to the reclaimed water from the treatment of sewage at the plant. The amount of reclaimed water made available to the city s be no less equal to an amount proportionate to the amount sewage produced in the city and treated at the plant.
