A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING A SPECIAL USE
PERMIT TO ALLOW FOR THE EXPANSION OF THE MEADOWLARK
RECLAIMATION FACILITY ON PROPERTY GENERALLY LOCATED
ON THE WEST SIDE OF RANCHO SANTA FE ROAD IN SAN
MARCOS CANYON.
APPLICANT: SAN MARCOS COUNTY WATER DISTRICT
CASE NO: SUP-6
WHEREAS, a verified application for certain property, to
A portion of the East one half of Section 30, Township 12 South, Range 3 West, San i3ernardino Meridian accord-
ing to the U. s. Government Survey
has been filed with the City of Carlsbad, and referred to the
Planning Commission; and
WHEREAS, said application constitutes a request as provid(
by Title 21 of the Carlsbad Municipal Code; and
MEREAS, the Planning Commission did on the 28th day of
April, 1982, consider said request; and
WHEREAS, upon hearing and considering all testimony and a
ments, if any, of all persons desiring to be heard, said Comm:
sion considered all factors relating to the Special Use Permii

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Comr
sion as follows:
(A) That the foregoing recitations are true and correct.
(B) That based on the evidence presented at the hearing, the ( mission APPROVES SUP-6, based on the following findings ar

2) The Special Use Permit is consistent with the purpose
the floodplain overlay zone because the proposed
engineering improvements to the site adequately mitis
the flood hazard to the site, and have been made
conditions of approval.
3) The Special Use Permit is consistent with all applica specific and general plans because:
a) The use of the site for a reclamation facility is conformance with the General Plan Land Use Elemen
designation of Public Utility.
b) The proposed engineering improvements to the site
implement the Public Safety Element's goal to minimizing injury, loss of life and damage to pro' resulting from flood disaster.
4) The issuance of the Special Use'Permit will not adver affect or unduly hinder, restrict or alter the water-
carrying function of the floodplain because of the proposed engineering improvements made conditions of approval specifically provide for the safe, efficient disposal of storm water and the Planning Commission c make the following findings:

a) The project will not cause danger to life and pro] due to increased flood heights or velocities causc encroachments in the floodway;
b) No danger from materials being swept into other 1, or downstream will be created;
c) The proposed water supply and sanitation systems 4 the ability of these systems to prevent disease, contamination and unsanitary conditions will not 1
affected by this project.
d) The use will not be susceptible to flood damage;
e) The use provides a service to the community;
f) The proposed use is compatible with existing development and development anticipated in the foreseeable future in the area;

g) The property would be accessible by emergency veh: in times of flooding ; and
h) The expected heights, velocity, duration, rate of
and sediment transport of the floodwaters expected
