APPLICANT: ENCINA WATER POLLUTION CONTROL FACILITIE CASE NO: PDP-1 (A) 6 11 WHEREAS, a verified application for certain propert) 7 8 9 10 11 12 13 wit: A portion of Fractional Section 20, Township 12 Sout Range 4 West, San Bernardino Meridian according to t U.S. Government survey approved October 25, 1875 anc portion of Lot "H" of Aqua Hedionda according to May filed November 16, 1896. has been filed with the city of Carlsbad, and referred to thc Planning Commission; and WHEREAS, said application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and 14 11 WHEREAS, the Planning Commission did on the 26th da] l5l1May, 1982, hold a duly noticed public hearing as prescribed t 16!) to consider said request; and 17 11 WHEREAS, at said public hearing, upon hearing and 18 19 considering all testimony and arguments, if any, of all persc idesiring to be heard, said Commission considered all factors 2o (/relating to the Precise Development Plan; and 21 22 23 24 B) That based on the evidence presented at the public hearil NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannil Commission as follows: A) That the foregoing recitations are true and correct. 25 26 Commission recommends APPROVAL of PDP-1 (A), based on the following findings and subject to the following conditio] Findings: 27 28 1) The Precise Development Plan ensures the compatibility 0: project with the city's General Plan for the following rt I c 1, 1.7 .l 0 0 1 2 3 4 5 a) The General Plan Land Use Element designates the sut property for a public utility use, b) The project is consistent with the goal and policy c public facilities element of the General Plan. 2) The proposed Precise Development Plan ensures the compatj of the development with surrounding development for the following reasons: 6 7 8 9 a) Conditions are imposed as part of this approval that mitigate all significant impacts resulting from the project. The landscaping shall be designed to screen facilities from views along 1-5, and surrounding propert Plans shall include fast growing tall trees, as well as combination of shrubs and ground cover. Grading plans shall be approved by the City Engineer or designee, prior to the issuance of a building permit. ! plans shall include provisions to limit grading to the n area necessary for construction of the facilities. Surfaces shall be graded to direct runoff toward design( drainage facilities and away from cut and fill slopes. Land shall not be cleared of vegetation except immediata before grading, and all slopes shall be established for control immediately upon completion of such grading. Ni vegetation shall be retained wherever feasible. A noise study shall be performed by a qualified noise e: order to establish acceptable noise levels at the propel of the treatment facility. Based on this study and sub: the approval of the City Engineer, all noise producing mechanisms and facilities shall be shielded and bufferec such a manner so as to reduce noise levels to the accepl level. All influent wastewater shall be pretreated in order to odors. In addition, the screening structures, grit rem( tanks, primary sedimentation tanks, and all open channe: including primary effluent channels, shall be covered a1 ventilated in order to remove odors. Odor removal towers are required and shall be delineate( final Precise Development Plan, subj.ect to the approval City Engineer. All necessary public improvements shall be installed SUI the approval of the City Engineer. If the JAC Board of Directors determines that a method of sludge disposal other than that incorporated i Phase I11 is feasible, such method may be implemented up approval of the City of Carlsbad. 8 17) 9 lo: 11 12 13 Upon approval, the applicant shall submit a reproducible of the Precise Development Plan which incorporates all requirements of the approval to the City Manager for signature. Prior to signing the final Precise Developme Plan, the City Manager shall determine that all applicab requirements have been incorporated into the plan and th conditions of approval have been satisfactorily met or otherwise guaranteed. The final signed Precise Developm Plan shall be the official site layout plan for the prop and shall be attached to any application for a building on the subject property. l4 11 Fire Department l5 16 18) Fire hydrants shall be placed on the site as required an 17 approved by the Fire Marshall.
