APPLICANT: PALOMAR VENTURES CASE NO: SDP 82-1 WHEREAS, a verified appliction has been filed with city of Carlsbad, and referred to the Planning Commission: a WHEREAS, said verified application constitutes a re1 as provided by Title 21 of the Carlsbad Municipal Code: and WHEREAS, pursuant to the provisions of the Municipa the Planning Commission did, on the 14th day of July, 1982, consider said request on property described as: A portion of Lot "H" of Rancho Agua Hedionda accord Map 823 filed November 16, 1896. WHEREAS, at said hearing, upon hearing and consider testimony and arguments, if any, of all persons desiring to 1 heard, said Commission considered all factors relating to Si Development Plan No. 82-1. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planni Commission of the city of Carlsbad as follows: A) That the foregoing recitations are true and correct. The Planning Commission has, by inclusion of an appropriate condition to this project, insured tha building permits will not be issued unless the Cit. The proposed project is compatible with the surrounding land uses since the surrounding properties are designatc industrial and extensive regional retail use by the Genc Plan. 4. This project as conditioned will not cause any signific< environmental impacts and a Negative Declaration has bel issued by the Planning Director on June 28, 1982 and ap] by the Planning Commission on July 14, 1982. General Conditions: I) Approval is granted for SDP 82-1, as shown on Exhibit(s) "F", dated June 1, 1982, incorporated by reference and or in the Planning Department. Development shall occur sub- stantially as shown unless otherwise noted in these condl 2) This project is approved upon the express condition that building permits will not be issued €or development of tk subject property unless the City Engineer determines that facilities are available at the time of application for : sewer permits and will continue to be available until tir occupancy. 3) This project is approved upon the express condition that applicant shall pay a public facilities fee as required 1 Council Policy No. 17, dated April 2, 1982, on file wit1 City Clerk and incorporated herein by reference, and accc to the agreement executed by the applicant for payment ox fee a copy of that agreement dated May 24, 1982, is on fj with the City Clerk and incorporated herein by reference. said fee is not paid as promised, this application will r consistent with the General Plan and approval for this pr shall be void. 4) Approval of this request shall not excuse compliance wit1 sections of the Zoning Ordinance and all other applicablc ordinances in effect at time of building permit issuance, PC Reso No. 1984 -2- . Loci of said receptacles shall be approved by the Planning Director. 19 I 20 21 Engineering Department 20) The developer shall obtain a grading permit prior to the mencement of any clearing or grading of the site. 22 23 24 25 26 21) The grading for this project is defined as "regular grad! Section 11.06.170(a) of the Carlsbad Municipal Code. The developer shall submit a grading plan for approval which include all required drainage structures and any require6 erosion control measures. The developer shall also submi soils, geologic or compaction reports if required and shz comply with all provisions of Chapter 11.06 of the Carlsk Municipal Code. 27 //// //// //// 28 PC Reso No. 1984 -3- L I1 e 0 1 2 3 22) The developer shall replace the existing asphalt berm on Palomar Airport Road with a concrete curb and gutter and install a sidewalk according to City standards and to th satisfaction of the City Engineer.
