HomeMy WebLinkAbout1982-08-11; Planning Commission; Resolution 1999-, - JI a 1 /I PLANNING COMMISSION RESOLUTION NO. 1999 2 3 4 5 6 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A VARIANCE TO REDUCE THE FRONT YARD SETBACK ON TWO UNITS OF A 64-UNIT PLANNED DEVELOPMENT ON PROPERTY GENERALLY LOCATED WEST OF NEBLINA DRIVE AND SOUTH OF FUTURE TAMARACK AVENUE. APPLICANT: TELESCOPE POINT CASE NO: v-337 7 11 WHEREAS, a verified application for certain property, to allwit: 9 A portion of Lot I of Rancho Agua Zedionda according to F 10 11 12 13 14 No. 823 filed in San Diego County November 16, 1896. has been filed with the City of Carlsbad and referred to the Planning Commission: and WHEREAS, said verified application constitutes a request provided by Title 21 of the Carlsbad Municipal Code; and 15 /I WHEREAS, the Planning Commission did, on the 1 lth day of 16 IIAugust, 1982, hold a duly noticed public hearing as prescribec 17 ll law to consider said request; and l8 I WHEREAS, at said public hearing, upon hearing and considc all testimony and arguments, if any, of all persons desiring I heard, said Commission considered all factors relating to V-3: 19 i 20 21 22 23 24 25 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public heari~ the Commission APPROVES V-337, based on the following findings and subject to the following conditions: 26 11 Findings: 27 28 1) That there are exceptional or extraordinary circumstance; that apply to this property or the intended use because t extensive topographical constraints. *- . 0 a 1 2 3 4 2) That this property would be denied a property right share other properties in the same vicinity and zone because ot developments contain highly varied setbacks. 3) That the granting of this variance would not be injuriou: the public health and welfare since such variance will ir way obstruct traffic visibility. 1 5 6 4) That the granting of this variance will not adversely efJ pleasing streetscape. the general plan because it will create a more aesthetic; Conditions 7 8 1) Approval is granted for V-337 as shown on Exhibit "D" dat 9 10 11 12 July 8, 1982. This exhibit is incorporated by reference on file in the Planning Department.
