I1 ,. 4 1 2 3 4 5 6 PLANNING COMMISSION RESOLUTION NO. 2049 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVA OF A ZONE CODE AMENDMENT, AMENDING TITLE 21, CHAPTER 21.24, SECTION 21,24.120 OF THE CARLSBAD MUNICIPAL CODE, BY THE ADDITION OF SUBSECTION 21.24.120(1) TO ALLOW THE DESIGNATION OF SPECIFIC DENSITY MAXIMUMS FOR PROPERTY IN THE RD-M ZONE. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 21, CHAPTE: 21.24 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF 21-24.120 REGARDING DENSITY IN THE RD-M ZONE. The City Council of the City of Carlsbad, Calif1 does ordain as follows: SECTION 1: That Title 21, Chapter 21-24 of the Carlsbad Municipal Code is amended by the amendment of Section 21.24.120 to read as follows: 21.24.120 Dwelling Units Per Lot (a) The number of dwelling units permitted on shall be consistent with the density speci by the general plan. (b) Whenever the general plan establishes dens in terms of ranges, the density for a proj shall be the lowest density established by range unless the Planning Commission or th City Council, whichever the final decision making body for a project is, finds that a greater density within the range is justif under the provisions of the general plan. (c) Whenever property which is zoned or which proposed to be zoned RD-M is located in a transitional area between existing residen neighborhoods and other uses, or in a tran tional area between property zoned for res tial uses and property zoned for higher de residential uses or other uses, the City !Counc%l may designate the maximum density permitted on the property at a point withi the range established by the general plan.
