APPLICANT 2 SOUTHERS CASE NO: SP-185 7 II WHEREAS, a verified application for certain property 8ilwit: 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 A portion of Rancho Agua Hedionda, as delineated on Record of Survey Map No. 5342 filed on January 26, 1 in the City of Carlsbad, County of San Diego, State California. has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application constitutes a reql provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 9th day February, 1983, hold a duly noticed public hearing as prescrj law, to consider said request; and WHEREAS, at said public hearing, upon hearing and cor ing all testimony and arguments, if any, of all persons desil be heard, said Commission considered all factors relating to Specific Plan; and NOW, THEREFOREB BE IT HEREBY RESOLVED by the Planning Cor sion as follows: (A) That the foregoing recitations are true and correct. (B) That based on the evidence presented at the public hearil Commission recommends APPROVAL of SP-185, based on the following findings and subject to the following conditio] Findings: 1) The site is physically suitable in size and shape to 28 accommodate the proposed uses because the Specific Plan I! < ? 0 0 1 2 2) 3 4 5 6 4, 7 3) 8 5) 9 10 11 12 13 14 15 16 17 18 19 2o I 21 22 23 24 25 26 27 28 PC provides standards for development which accommodate the project with the site. The proposed uses will not be detrimental to adjoining properties for the reasons outlined in the staff report. The specific plan is consistent with the Carlsbad Genera and with Sections 65451 and 65452 of the Government Code regulate the use of specific plans. The specific plan implements the TS (Travel Service), OS Space) and 0 (Professional and Related Commercial) land designations designated for this property by the Land Us Element of the General Plan. An Environmental Impact Report was certified for this pr by the City Council on November 16, 1982. The EIR ident impacts from the proposed project. These impacts can ei be mitigated or overriding considerations exist as descr below. a. The loss of biologic resources associated with the m project, while significant, are offset by the social economic benefits of the proposed land uses and circ system. The proposed land uses are more conducive t preservation of the habitat areas being retained and inate the potential undesirable living environment c by traffic noise on Highway 78 and Marron Road. The proposed uses are also less subject to impacts from existing surface mine located east of the property. Development of office and commercial uses will provi and additional sales tax and property tax to the Cit b. Land Use - The proposed land uses are compatible wit existing and proposed adjacent uses and are more com than residential uses with the potential noise impac Highway 78 and Marron Road. Geology and Soils - Project modification to preserve additional floodplain areas and the steep slope area the southeast corner of the property have reduced PO impacts. Hydrology and Water Quality - Elimination of the mz of the proposed development adjacent to Highway 78 the steep slope areas in the southeast corner furth reduces the potential for on site sedimentation. E vation of the majority of the floodplain area and i mentation of mitigation measures contained in the E reduces potential impacts to an insignificant level Biological Resources - Project modifications to prc total of 29 acres of the riparian habitat and 18 ac supporting natural habitat, especially along the nc perimeter of the riparian area, reduces the impacts identified in the EIR. The total loss of 3 acres o riparian habitat and additional supporting habitat, however, is still deemed to be an unmitigated signi adverse impact. Archaeological Resources - Preservation of the area adjacent to Highway 78 and in the southeastern corn preserve 3 of the identified sites, thereby reducin impacts identified in the EIR. Implementation of t. additional measures noted in the EIR reduces the OVI impact to one of insignificance. Visual Aesthetics - Eliminating the majority of the development adjacent to Highway 78 will eliminate a1 potential "freeway strip effect." The addition of overlay zone and implementation of the other measurc contained in the EIR reduces potential impacts to a1 insignificant level. Traffic Circulation - Potential traffic impacts at E Road and El Camino Real can be reduced to an insigni level by the construction of turning lanes and medii recommended in the EIR and in comments from the Cit: Traffic Engineer. Noise - No significant impacts are anticipated. Thc proposed land uses are less subject to any potential impacts than the existing residential designation. Air Quality - Identified significant adverse impacts cumulative in nature. Specific mitigation measures reduce these impacts can be reviewed and implemented approval of site development plans required by the C lay zone.
