HomeMy WebLinkAbout1983-03-23; Planning Commission; Resolution 2096*. 4- 1 e 0 PLANNING COMMISSION RESOLUTION NO. 2096 2 3 4 5 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIAf RECOMMENDING APPROVAL OF A ZONE CHANGE FROM COUNTY-A-70 TO CITY OF CARLSBAD P-C ON PROPERTY GENERALLY LOCATED ON THE SOUTH END OF GLASGOW DRIVE, APPLICANT: ROY J. WARD COMPANY CASE NO: ZC-273 6 I1 WHEREAS, a verified application for certain propert 7 wit: /I a 9 10 11 12 13 14 15 Lot 29 of Calavera Hills according to Map No. 9335 filed December 16, 1982, and a portion of Lot "E" of Rancho Agua Hedionda according to Map 823 filed November 16, 1896, has been filed with the City of Carlsbad, and referred to tk Planning Commission; and WHEREAS, said application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 23rd d; March, 1983, hold a duly noticed public hearing as prescribc 16 17 18 19 law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all per: desiring to be heard, said Commission considered all factor: relating to the Zone Change; and 2o I 21 22 23 24 25 Commission recommends APPROVAL of ZC-273, based on the NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plann: Commission as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hear: following findings and subject to the following conditic 26 11 Findings: 27 IJ 1) The proposed change of zone to P-C is consistent with tl 28 General Plan designation of RLM since a designation likl * ,- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 28 19 20 21 22 23 i ~ 0 0 is applied to an area that is suitable for single family residential development. 2) The proposed P-C zone is compatible with the surrounding properties since the properties to the north and east arc P-c. 3) The proposed change of zone to P-C is appropriate becausl subject property will become a part of the Calavera Hill! Master Plan area, all of which is zoned P-C. 4) The project is consistent with all City public facility : icies and ordinances since the applicant has agreed and required by the inclusion of an appropriate condition to public facilities fee. Performance of that contract and payment of the fee will enable this body to find that pu facilities will be available concurrent with need as req by the General Plan. j 5) This project will not cause any significant environmenta impacts and a Negative Declaration has been issued by th Use Planning Manager on March 11, 1983 and approved by t Planning Commission on March 23, 1983. 6) The proposed change of zone is consistent with all other elements of the General Plan. General Conditions: 1) Approval is granted for ZC-273, as shown on Exhibit "A" February 21, 1983, incorporated by reference and on fil the Land Use Planning Office. Development shall occur stantially as shown unless otherwise noted in these cor tions. 4) This project is approved upon the express condition th; applicant shall pay a public facilities fee as requirec City Council Policy No. 17, dated April 2, 1982, on fi: the City Clerk and incorporated herein by reference, a: according to the agreement executed by the applicant fc payment of said fee, a copy of that agreement, da.ted January 17, 1983, is on file with the City Clerk and i: rated herein by reference.
