APPLICANT: IMTERAMERICAN DEVELOPMENT CASE NO: SDP 78-1(C) WHEREAS, a verified application has been filed with City of Carlsbad and referred to the Planning Commission; an( WHEREAS, said verified application constitutes a re( as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission approved Site neve: Plan, SDP 78-1(B), with Resolution No. 1854, dated Auqust 26 and WHEREAS, pursuant to the provisions of the Municipa: the Planning Commission did, on the 27th day of April, 1983, consider a modification to approved Site Development Plan 78- on property described as: A resubdivision of Parcel 2 of Parcel Map No. 1QQ6Q filed in San Diego County on May 23, 1980; WHEREAS, at said hearinq, u?on hearing and consider: testimony and arguments, if any, of all persons desiring to 1 heard, said Commission considered all factors relating to Sii Development Plan No. 78-1(C). NOW, THEREFORE, RE IT HEREBY RESOLVED by the Plannil Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the hearing, the Commission recommends approval of SDP 78-1(C), based on i following findings and subject to the followinq conditio] i- e e 1 Findings: 2 3 4 5 6 1) The project is consistent with the City's General Plan f the proposed development is consistent with the P-I, Ple Industrial, land use designation specified for this pro: by the General Plan. 2) The site is physically suitable for the type and density the development since the site is adequate' in size and i to accommodate the proposed development. 7 icies and ordinances since: 3) The project is consistent with all City public facility 8 9 x0 11 12 13 14 15 16 1'7 18 4) a) The Planning Commission has, by inclusion of an appr ate condition to this project, insured that the buil permits will not be issued unless the City Council f that sewer service is available to serve the project b) All necessary public irn?rovements have been provided will be required as conditions of approval. c) The applicant has agreed and is required by the incl of an appropriate condition to pay a public faciliti fee. Performance of that contract and payment of th will enable this body to find that public facilities be available concurrent with need as required by the general plan. d) Assurances have been given that adequate sewer for t project will be provided by the City of Carlsbad. The proposed project is compatible with the surroundinq land uses since surrounding properties to the south and are designated for industrial development on the General and a canyon separates the property from residentially designated property to the north. 15) The proposed project, as proposed, will not cause any environmental impacts and a Notice of Prior Compliance h been issued by the Land TJse Planning Manager and approve the Planning Commission on April 4, 1983. Conditions: 1) Approval is granted €or SDP 78-1 (C) , as shown on Exhibit and "B", dated April 8, 1983, incorporated by reference file in the Land Use Planning Office. Development shall substantially as shown unless otherwise noted in these conditions. 2) This project is aDproved upon the express condition that final map shall not be approved unless the City Council as of the time of such approval that sewer service is available to serve the project. 3) This project is approved upon the express condition that PC RES0 NO. 2111 2. .* 0 e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 building permits will not be issued for development of subject property unless the City Engineer determines t: sewer facilities are available at the time of applicat such sewer permits and will continue to be available u: time of occupancy. 4) This project is approved upon the express condition th applicant shall pay a public facilities fee as require City Council Policy No. 17, dated April 2, 1982, on fi the City Clerk and incorporated herein by reference, a according to the agreement executed by the applicant f payment of said fee, a copy of that agreement, dated M 1981, is on file with the City Clerk and incorporated by reference. If said fee is not paid as promised, th application will not be consistent with the General P1 approval for this project shall be void. 5) Approval of this request shall not excuse compliance w sections of the Zoning Ordinance and all other applica ordinances in effect at time of building permit issuan 6) This approval shall become null and void if building p are not issued for this project within two years from of project approval. 7) Water shall be provided by the City of Carlsbad unless other arrangement is approved by the City Council. Land Use Planning: 8) The applicant shall prepare a reproducible mylar of the site plan incorporating the conditions contained herein site plan shall be submitted to and approved by the Lan Planning Manager prior to the issuance of building perm 9) The applicant shall establish an owner's association an corresponding covenants, conditions and restrictions. CC&R's shall be submitted to and approved by the Land U Planning Manager prior to final map approval. 10) The applicant shall prepare a detailed landscape and i tion plan which shall be submitted to and approved by Use Planning Manager prior to the issuance of building permits. 11) A 500' scale map of the subdivision shall be submitted Land Use Planning Manager prior to the recordation of final map. Said map shall show all lots and streets w and adjacent to the project. 12) All parking lot trees shall be a minimum of 15 gallons size. 13) All landscaped areas shall be maintained in a healthy thriving condition, free from weeds, trash, and debris PC RES0 NO. 2111 3. .* I/ 0 0 1 2 14) 4 3 5 6 7 17) 8 9 10 11 12 13 14 15 16 17 18 15) 16) 18) 19) Any signs proposed for this development shall be design conformance with the City's Sign Ordinance and shall re review and approval of the Land Use Planning Manager pr installation of such signs. A uniform sign program €or this development shall be st to the Land Use Planning Manaqer for his review and apy prior to occupancy of any building. Trash receptacle areas shall be enclosed by a six-foot masonry wall with gates pursuant to City standards. La of said receptacles shall be approved by the Land Use P Manager. All roof appurtenances, including air conditioners, sha architecturally integrated and shielded from view and t sound buffered from adjacent properties and streets, pu to Building Department Policy No. 80-6, to the satisfac the Land Use Planning Manager and Building and Planning Director . The developer shall grant an open space easement over t entire slope area on the northern Portion of the site. easement shall extend from the edge of the buildable pa the top of the existinq natural slope to the northern F line. This area shall be considered a natural preserve allowing no development. This easement shall be dedica prior to the issuance of building permits. This area s maintained by the property owners and a statenent so indicating shall he included in the CC&R's. No permanent landscaping shall be planted within the 36 wide centerline-to-curb access easement to the City Ope property. The structural section of all privat streets shall conform to City of Carlsbad Standards bas R-value tests. All private streets and drainage svstem be inspected by the City, and the standard immovement check and inspection fees shall be naid mior to approv the buildinq permits. 12 27) A11 private streets and drainage systems shall be maint by the homeowners association in perpetuity.
