A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING THE
RESCISSION OF SP-40 LOCATED ON THE WEST SIDE OF
INTERSTATE 5 BETWEEN KNOWLES AVENUE AND LAGUNA DRIVE
APPLICANT: CITY OF CARLSBAD

WHEREAS, a verified application for certain property
to wit:
Portion of Sunny Slope Tract, Map 486 and the north
half of the northwest quarter of Section 6 Township
South, Range 4 West, San Bernardino Meridian

has been filed with the City of Carlsbad and referred to the
Planning Commission; and
FMEREAS, said verified application constitutes a req
as provided by Title 21 of the Carlsbad Municipal Code: and
WHEREAS, the Planning Commission did on the 11th day
14 I/May, 1983, hold a duly noticed public hearing as prescribed b
15/11aw to consider said request; and

WHEREAS, at said public hearing, upon hearing and
considering all testimony and arguments, if any, of all perso

desiring to be heard, said Commission considered all factors
\relating to the Specific Plan; and
2o II NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannin
21 /Commission as follows:

A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearin
the Commission recommends RESCISSION of SP-40, based on
the following findings and subject to the following
conditions:
Findings: 26 111) The proposed specific plan amendment is consistent with t
General Plan for the reasons stated in the staff report.
2) The proposed specific plan amendment will not adversely
effect the subject properties or adjacent properties for reasons stated in the staff report.

1 3) Specific Plan 40 is no longer consistent with the existin

development standards of the City of Carlsbad nor with th

existing development in the surrounding vicinity.
the 11th day of May, 1983, by the following vote, to wit: 5

PASSED, APPROVED AND ADOPTED at a regular meeting of

AYES : chairman- Schlehubr , Commissioners Marcus, Farrow,
-tis, Jose, Friestedt and Rawlins. NOES ; None.
